Sex robots appear to be the next big thing for the adult entertainment industry. Unroboticised sex dolls are not new – but combined with state-of-the-art fabrication techniques, Artificial Intelligence (AI) and programming applications, such dolls may soon reach new levels of sophistication.
As sex dolls become increasingly realistic – and their roboticisation looms on the horizon – a key question to ask is how the law should respond when such objects are made for, and used by, those with a sexual interest in children?
Dolls for this market, manufactured overseas, are now starting to appear on the legal radar from attempts to import them into the country. The National Crime Agency (NCA) has warned that child-like sex dolls are being sold on the internet and campaigners have urged the government to outlaw the trade . There have also been calls to ban the import of sex robots designed to look like children.
How to deal with such dolls and their robot counterparts is a novel question for the law. In June 2017, an attempt to import a sex doll resembling a child was successfully prosecuted at Chester Crown Court. The legislation used dated back to 1876. Section 42 of the Customs Consolidation Act prohibits the importation of:
Indecent or obscene prints, paintings, photographs, books, cards, lithographic or other engravings, or any other indecent or obscene articles.
While dealing with a novel problem, the sentencing judge seemed confident that a crime had been committed. The conviction now clearly establishes that it is a crime to import such a doll, and presumably a robot sex doll as well, but other matters remain unclear.
What if the object had crossed the border undetected? The current child protection framework has largely been designed for two-dimensional material – such as photographs and videos . So it would appear that the mere possession of a child sex doll and its robotic counterpart is not currently a criminal offence. The mere fact of possession may not easily be linked to a chain of evidence in relation to the now-established crime of importation. It is feasible that, given the drop in the cost of technology, such as 3D printers, and the emergence of sex-robot programming apps, such items could soon be created domestically, without the need for importation. Currently, the creation of child sex dolls and robots is not a crime.
The Chester conviction supports the presumption that the object ought to be criminalised, yet there is no consensus on whether child sex robots and dolls ought to be criminalised in the first place. It has been argued that sex dolls might have “therapeutic” use for sex offenders, as a sort of “safety valve” to divert the potential offender from turning their attentions to an actual child.
Other voices challenge this view. In their 2017 report , the Foundation for Responsible Robotics explored this question. They noted that a Japanese company had already been selling child sex dolls for over a decade but that there were serious questions over the ethics of “treating” sex offenders with such robots because it was hard to test how such interventions might work. It was also argued that such robots could have the opposite effect of reinforcing, rather than suppressing problematic desires.
It is notable that the defendant in the Chester case was also charged with making and possessing indecent images of children and in a more recent case another defendant was found to have possessed or made over 34,000 indecent images of children.
These cases suggest that the creation of a new spectrum of offences is both likely and increasingly necessary. Accordingly, we need to consider where offences like advertising, dissemination, creation and possession of sex dolls and robots would fit into the child protection framework. The existing offence prohibiting non-photographic, pornographic images of children – created by the Coroners and Justice Act 2009 – was designed to catch fabricated images such as computer-generated or cartoon pictures. Perhaps this could be adapted to include dolls and robots?
But we might have to consider whether an entirely new set of offences would better cover this unusual issue. Should the fact that 2D has now moved to 3D make the offence more serious because sex dolls and robots could increase the possibility of incitement to harm due to their added realism? Should a doll be considered the same as a robot? Would the degree of roboticisation make a difference to the seriousness of the offence?
Likewise, if the doll or robot was found to be somehow linked to a real child, should this be considered to be the same as a photograph of a real child? What defences might be applicable? More broadly, the fact that such items are available for import suggests that international-level action as well as domestic legislation is necessary for more effective child protection. Crime is evolving alongside technology. The law needs to keep up and think ahead in order to meet the challenges of the future.

A man has been found not guilty of importing a child sex doll he found online.
Daniel Adams was looking to buy the sex toy and said he did not know the doll was designed to imitate a young girl's body.
He denied buying the 3ft 3in doll knowing it was made for this intention and was acquitted by a jury on Friday, Essex Live reports.
Adult sex dolls are not illegal in the UK, but child sex dolls are.
The 32-year-old, from Langham, Essex, stood trial at Chelmsford Crown Court.
During the trial, the jury found out more details about the doll.
Prosecuting, Christopher Martin QC, told the court: "The sex doll was said, in its online advertisement, to be '100% like a young girl's body'.
"It measured to be 99cm in length, or height.
"In the actual advert it is described as being 3ft 3in tall, which you may or may not already know is the height of a young girl between four and six-years-old."
The naked doll was then stood up next to the jury.
On Monday the court hear how on March 10, 2016 at around 10.50pm, Adams started searching online for a sex doll.
Mr Martin said: "Whilst he was searching, he opened pages which described sex dolls of 158cm in height.
Adams purchased the doll on July 29, 2016 and bought the item for £500 from the seller who is based in Hong Kong, China.
But on August 11, 2016 the parcel containing the sex doll was intercepted by a UK Border Force officer at East Midlands Airport.
Other items including brown, blonde and pink wigs, a dress and a cleaning kit were also found inside the parcel, the court was told.
This information was then passed on to Essex Police who arrested Adams on October 28, 2016.
In an interview he admitted to buying the doll but was certain the seller had not listed the size.
Before purchasing the item, Adams allegedly had a conversation with the seller.
Seller: Thank you for your interest in the item. It uses genuine silicone technology to mimic a young girl.
Daniel Adams: OK, thanks for explaining everything. Can you do a deal for £500?
The seller then offered to vary the hair, skin and eye colour.
Daniel Adams: Can I get the red hair, brown hair and can you throw in the brown one too?
Daniel Adams : The item is being held in customs for some reason. This item is definitely legal yes?
Daniel Adams: Hello, please can you issue me with a refund as it's still in customs and I don't want to bring anything into this country that is not legal.
Daniel Adams: You need to call DHL and ask them to send it back as I don't want this anymore. I thought it was taller. I will cover the cost of delivery for the hassel.
DC Knight, leading officer in the case, gave evidence of the police interview in which Adams denied purchasing the item with the knowledge it was a child sex doll.
An open search investigation was also conducted using Adams' eBay log in to look at his purchase history.
His laptop, iPhone and iPad were also forensically examined.
But Adams was cleared by a jury today who found him not guilty on the directions of the judge who stated there was no evidence put before them that the defendant had committed an offence.

FORT MITCHELL, Ky. --  Is a child sex doll child pornography?
That question was at the center of a recent case in Kenton Circuit Court after a Fort Mitchell man was arrested when a child sex doll sent from China was delivered to his house.
The Fort Mitchell man, whom we’re not naming, came to court charged with having an item portraying a sexual performance by a minor. But Judge Douglas Grothaus dismissed the sex charge, ruling that a doll isn’t a person and therefore not child porn.
The Commonwealth is deciding whether to appeal and whether to try to change state law.
Kentucky State Police were watching when a package was delivered to his apartment building on Sept. 25. Knowing the resident ordered a sex doll, they waited to make sure he accepted the delivery.
“When they went in, not only did they find the package that they had intercepted contained a child sex doll, but also found another doll that represented a child that was also being used as a sex doll,” said Rob Sanders, Kenton Commonwealth Attorney.
Sanders told WCPO he’s never seen a case quite like this.
“Certainly, it’s shocking,” said Sanders. “My first reaction when the state police brought me this case was, ‘Who even makes a child sex doll?’ That’s just disgusting.
Search warrants show investigators seized two female sex dolls — one resembling a 6-to-8 year old and the other an infant — plus a computer and cell phone.
“There was a legal issue that was put forth by the defense attorney to the judge about whether or not a doll constitutes matter portraying sexual performance of a minor,” Sanders said.
The judge said he found the doll and the defendant’s actions repulsive, but he dismissed the charge because no actual child was involved. He based it on a Ninth Circuit federal court decision, but Sanders disagrees.
“We think a doll can represent an actual child especially when you can order a child’s baby doll to look like your child, you can order these child sex dolls to look like a specific child as well,” Sanders said.
 While he’s deciding whether to appeal, Sanders is urging Kentucky legislators to pass a law saying a sex doll is child porn.
“That way we won’t have to have this dispute if anyone’s sick enough to order a child sex doll in the future,” Sanders said.
Kentucky State Rep. Adam Koenig says he’s on board with changing the law.
“We just need to look at it and make it clear that we really don’t want the selling or the ownership of these child sex dolls in Kentucky,” Koenig said. 
There’s also federal legislation being considered called the CREEPER Act (Curbing Realistic Exploitative Electronic Pedophilic Robots). The act passed the House in June and has been referred to a Senate committee.
Police said they found a small amount of pot in the Fort Mitchell’s man’s house and charged him with possession of marijuana and drug paraphernalia. He has a court date Oct. 18.
