A woman accused of having a sexual relationship with a 17-year-old female student while teaching at a Utah high school has avoided jail and will have to serve 100 hours of community service, 18 months of probation and pay a $900 fine instead.
Courtney Louise Jarrell, 23, had faced up to three years in jail, but Judge Bruce Lubeck today decided against any time in prison after both prosecutors, Jarrell’s lawyers and even the student asked that she be kept out of jail.
In February, Jarrell pled guilty to three counts of misdemeanor sexual battery and agreed to give up her teaching license. She initially faced charges of object rape, a first-degree felony, and forcible sexual abuse, a second-degree felony.

By pleading guilty to misdemeanor charges, she does not have to register as a sex offender.
‘I’ve lost my teaching license and that was something that I worked really hard for and I've been punished throughout the year with different things,' Jarrell told Lubeck, crying, KSL reported. ‘I'll never be in a school again like that. I don't even know if I can go on field trips with my nieces' or nephews' or kids' schools and that's really hard for me. I feel like it was a big deal for me to lose that.’
Jarrell was accused of touching the female student's breast and genitals. She had been initially charged with object rape and forcible sexual abuse, but the charges have been downgraded to a middemeanor under a plea.
Her attorney, Ken Brown, said that Jarrell is still the focus of criticism and has lost her teaching license as a result of her action. He added that Jarrell told the student to wait until she was 18 before having sex. In February, he said the relationship was consensual as well
‘Ms. Jarrell is a good person and, as I indicated throughout this case, she fell in love with a student,' he said. ‘I don't think she was abusing anyone's trust.’

Jarrell was arrested in April 2013 on allegations she fondled and raped a 17-year-old female student, just eight months after she took a job teaching at Riverton High School.
The school district received a complaint in March of last year that Jarrell had had sexual contact with one of her female students.

The alleged abuse took place at her home last February or March. Police said she touched the female student's breasts and genitals.
Jarrell taught math at Riverton High and coached the sophomore girls' basketball team.

A teacher has been charged with rape after allegedly inviting a teen over for a threesome with a female colleague while her husband was away.
A married mother-of-two has been arrested and charged with first-degree rape this week after reports emerged of the alleged sexual assault of a teenage school student.
Joyce Churchwell, 40, is alleged to have invited the 18-year-old male student over to her house last year after first chatting to him on Snapchat.
The conversations on Snapchat escalated to Ms Churchwell sending naked photos of herself to the student, according to police.
Late last year, while Ms Churchwell’s husband was away, she invited the student over to her house to have sex with her and another female teacher from Berryhill High School in Tulsa, Oklahoma.
It is reported that rumours of the abuse went around the school in December with the student eventually telling police what happened with the two women.
The other woman who was allegedly involved with the threesome has not been charged as she has since left the school.
While the age of consent in Oklahoma is 16, adults can still be charged for sexual assault if they were in a position of authority over their victim.
In this case Ms Churchwell was the boy’s volleyball coach. She has since been on a leave of absence from her job.
A social media account that appears to belong to the teacher makes references to her Bible studies and volleyball coaching.
Berryhill High School is co-operating fully with the investigation into Ms Churchwell’s alleged crimes.
“Berryhill School District takes the safety of its students very seriously and does everything it can to provide a safe learning environment,” said a spokesman.

BRONX, NEW YORK — A teacher was fired after she was found hiding behind her high school student's bed.
Officials at the Department of Education (DOE) claimed that Tamara A. Alvarez, 35, who taught history at the Bronx High School for Writing and Communication Arts, had a romantic relationship with her female student after she was found "hiding behind the bed" of the teenager in May 2017, according to disciplinary records viewed by the New York Post .
The shocking discovery was made by the boyfriend of the teen's mother.
When the victim's mother broke her foot and was hospitalized. She told her boyfriend to check on her daughter who was alone at home.
However, when he dropped by, there was no one in the house.
While in the house, he heard someone entering the residence and going into the daughter's bedroom.
Although he knocked on the door, no one answered.
After the student got home, both of them opened the door to her bedroom to find “a woman hiding behind the bed.”
The report added that after her mother's boyfriend asked Alvarez to leave, the teenager left the house too and refused to return home and stay with her family.
Before her teacher was found hiding behind her bed, the student had reportedly told her family that “she was dating a woman in her late 20s" without revealing who the person was.
Her mother reported Alvarez to the school authorities after the latter was identified by the boyfriend as the woman who was hiding behind her daughter's bed when she appeared on stage at the school’s graduation ceremony.
The fact that her mother had taken action against her teacher infuriated the victim even more.
“Mom, why are you doing this? She has kids," she reportedly told her mother.
After a probe into the teacher's conduct was launched by the city’s Special Commissioner of Investigation, Alvarez was found to have texted the student at least 800 times between February and May 2017. The student had contacted the teacher about 500 times.
“Her involvement with this student is simply an obsession,” a DOE lawyer argued, which was countered by the defense lawyer saying Alvarez was only trying to help the victim who was struggling in school.
The accused's attorney further argued that the DOE did not impose any restrictions on the lengths of telephonic conversations between teachers and students. “We’re here because [Alvarez] is a lesbian,” her lawyer contended. “This is the very definition of unequal treatment.”
Alvarez's defense was not bought by hearing officer Sarah Miller Espinosa who terminated the accused's employment on Jan. 3 citing that she “targeted a vulnerable special education student” and “violated her position of trust.”
