INDIAN RIVER COUNTY (CBSMiami) – An 18-year old lesbian could face up to 15 years in prison, and be registered as a sex offender, after she allegedly had a relationship with her 14-year old high-school basketball teammate.
Kaitlyn Hunt, a high school cheerleader and star basketball player of Indian River County, is charged with two felony counts of lewd and lascivious battery on a child 12 to 16 years old, according to CBS4's partner The Miami Herald .
"It's mind blowing that she's facing felony charges and sexual predator status," said her mother Kelley Hunt-Smith.
She believes the issue is not about age, it's about sexual orientation.
"This is being fueled by the other girls parents. They're not accepting of their relationship because it's a girl on girl relationship. In my opinion, this has nothing to do with age, if Katilyn was a boy they would not have a problem," said Hunt-Smith.
Hunt, who turned 18 on August 14, 2012, was said to have been dating the 14-year old, C.S., since November.
The girls began their fling just before Christmas when they had consensual sex in a bathroom at Sebastian River High School, according to the paper.
In Florida, the legal age of sexual consent is 18 and the state's adopted "Romeo and Juliet" law keeps 18 year olds from being registered as sex offenders if they had consensual sex with classmates age 15 or older; but Hunt's case doesn't qualify because C.S. was underage, Indian River State Attorney Bruce Colton told the Herald.
When the girls' basketball coach found out about the girls' romance, she kicked Hunt off the team and informed her girlfriend's parents about their same-sex relationship.
When Hunt got home that day, she was unaware of what would happen next.
On February 16 th , Indian River sheriff's deputies showed up at Hunt's home, handcuffed and arrested her, then took her to the sheriff's office where they read Hunt her Miranda rights.
Hunt admitted to having a relationship with C.S. but didn't think about the age being a problem because she "acted older," said detective Jeremy Shepherd in a report.
However, Indian River Sheriff, Deryl Loar doesn't see it that way. He said she knew a sexual relationship with a 14-year old was wrong.
"Before Ms.Hunt was arrested there were conversations in social media that she knew she was 18 and she knew what she was doing was wrong with a younger person," said Loar.
Hunt's friends and family are doing everything they can to help her, they even set up a Facebook page for support, called "Free Kate," which now has more than 25,000 members.
Her friends also began an online petition on Monday at Change.org called "Stop the prosecution of an 18 year old girl in a same-sex relationship," where more than 85,000 supporters have signed for charges against Hunt be dropped.
Within 24 hours, the nonpartisan campaign website collected 57,414 from all over the world, Change.org's deputy campaign director, Jon Perri, told the Herald.
However, others are calling Hunt a predator; at school, students are divided.
"She's not a sex offender, she shouldn't be charged with any of that," said classmate Nicole Bolton.
"Everyone knows the laws, you can't break them," said another classmate, Joseph Reh.
There is a plea deal on the table. If Hunt pleads guilty to third-degree child abuse, it would reduce the charges to two counts of felony child abuse, which would get rid of the jail time and land her two years of house arrest.
Hunt has until Friday to decide whether or not she wants to take it.

Aug. 16, 2013— -- A Florida teenager who was charged earlier this year for having a sexual relationship with her underage girlfriend is being accused of additional felony behavior after she allegedly continued to text and liaise with the girl in recent months.
Kaitlyn Hunt, a 19-year-old recent high school graduate who began dating her then-14-year-old cheerleading teammate in 2012, is accused of exchanging more than 20,000 texts with the younger girl since she was initially charged in the case, according to authorities.
Hunt is charged with lewd and lascivious conduct on a child ages 12 to 14 for the sexual relationship she had with the younger girl, whose identity has not been made public. She has denied the charges.
Prosecutors in the case filed a motion in Indian River County, Fla., this week stating that Hunt and the girl sent text messages, lewd and lascivious photographs, and videos of Hunt, including one of her pleasuring herself.
The state also said the pair met for sex numerous times. The prosecutor's office declined further comment on the case today.
Hunt's attorney, Julia Graves, said in a statement to ABC News that the new allegations have not yet been proven.
"As with any high profile case there is great public interest in the various details of the investigation," Graves said. "However, it is customary as the process unfolds that allegations will be made, but they must be proven and substantiated in a court of law."
An attorney representing the younger girl's family released a statement today condemning the continued contact between the pair.
"The parents were totally unaware of any communications between the defendant and their daughter. It recently came to [the familiy's] attention and they immediately went to authorities who investigated that Kaitlyn Hunt had supplied an iPad to not only communicate with their daughter, but to also provide explicit images over this device. This was in direct violation of the pretrial conditions of her release," attorney Charles Sullivan Jr. told ABC.
"The parents believe that someone who truly cared for their daughter would not be engaging in this type of activity," he said.
The prosecutor's office declined to say whether they would seek jail time for Hunt given the additional accusations filed this week. A court hearing will be set based on the motion, the office said.
Prosecutors offered Hunt a second plea deal in recent weeks that the family is still considering, though they would like to see a plea deal that reduces the charges from felony to misdemeanor, according to a statement Hunt's mother made on Facebook.
"It is still a FELONY plea," Kelley Hunt Smith wrote online. "They are wanting THREE years of a felony type probation to include curfews, 500 feet away from the other girl, including the school where her sister attends, so she wouldn't be able to attend any family functions, or her sister's graduation."
The girls were 18 and 14 when they became sexually involved, according to an arrest affidavit by the county Sheriff's Department.
Hunt's uncle, Andrew Gay, told ABC News in May that the pair was part of the same friend group when they became romantically involved. According to Gay, the high school girls basketball coach at their school found out about the relationship, told the younger girl's mother, who also works as a coach, and kicked Hunt off the team, according to Hunt's family.
The younger girl's parents then contacted police, according to the Hunt family.
The police then set up a phone sting operation in which the 14-year-old called Hunt and asked her details about their relationship, according to the affidavit. Police arrested Hunt in February based on the details the girls discussed on the phone, according to the document. She was charged and spent 24 hours in jail before posting bond.
"Our family's perspective on this is that Kaitlyn made a poor choice, but this is something that could have been dealt with between families," Gay said.

He falls in with other LGBT students who form a secret support group that they call the Geography Club.
This 2006 comedy is set in 1980s Europe at an international high school and follows gay student Chance Marquis who is bullied for his sexual orientation. When he discovers self-expression through drag, he realizes the only way he’ll ever fit in is by standing out.
This 1998 high school dramedy is set in Sandusky, Ohio in 1984. Eric is a Eurythmics-obsessed teenager who is coming to terms with his sexual orientation, and dreams of moving to New York after graduation.
The 2018 film (based off of Becky Albertalli's young adult novel Simon vs. the Homo Sapiens Agenda ) follows the story of typical, suburban high school senior Simon Spier as he tries to navigate life after being blackmailed and threatened with outing by one of his classmates while also trying to figure out the identity of his anonymous, romantic, online pen pal named Blue.
Although there are serious themes and instances of casual homophobia throughout the movie, like most teen rom-coms, the ending is really sweet and gives the audience a feeling of hope for the titular character and his life as a newly-out, gay man.
Olivia Wilde's 2019 feature directorial debut, Booksmart is a hilarious coming-of-age film that stars IRL queer actress/ Lady Bird star Beanie Feldstein and Unbelievable 's Kaitlyn Dever as smart-as-hell high school seniors Molly and Amy as they try to live it up on their last night as high schoolers. One of the storylines in the film centers around Amy (Dever), an out lesbian, trying to muster up the courage to tell her crush she likes her.
