Lawmakers Propose Reviving Letters of Marque to Target Cartels
Rep. Tim Burchett and Sen. Mike Lee are calling for legislation that would authorize the use of “letters of marque and reprisal” to allow privately contracted operators to target drug cartels operating outside the United States. The concept, referenced in the U.S. Constitution, historically permitted the government to commission private parties to act against hostile forces. Burchett argued the approach could enable highly trained former military personnel to pursue cartel networks without deploying U.S. armed forces directly into another sovereign country. Supporters say the measure would provide flexibility in confronting transnational criminal organizations, while critics are likely to raise legal, diplomatic, and oversight concerns about outsourcing the use of force.
