The Duke and Duchess of Cambridge won damages of £92,000 from the French edition of Closer in 2012 after it published topless pics of Kate
THE Duchess of Cambridge was awarded £92,000 after after a French mag published nude pics of her.
Celeb glossy Closer printed snaps of Kate sunbathing topless during a chateau holiday in 2012. Here's the latest on the scandal.
Kate and William escaped on holiday in France in September 2012, a little more than a year into their marriage, when the paparazzi shots were taken.
They were in a chateau in the south of France owned by the second Earl Snowdon, the Queen's nephew.
The Duchess of Cambridge was sunbathing topless when a photographer using a long-range lens snapped images of her.
The photographs were then published by Closer, alongside an article about the couple under the headline "Oh my God!".
Local paper La Provence also published pics of the royals holidaying in private.
The couple sued the French magazine Closer for £1.3million, and demanded a further £42,000 in damages from La Provence.
The magazine published the topless photographs, believed to have been taken from a public road, while La Provence published swimwear photos.
The Duke and Duchess of Cambridge enlisted lawyers to sue six people alleged to have been involved, claiming an invasion of privacy.
In a statement read out to the court, Prince William said: "In September 2012, my wife and I thought that we could go to France for a few days in a secluded villa owned by a member of my family, and thus enjoy our privacy.
"We know France and the French and we know that they are, in principle, respectful of private life, including that of their guests.
"The clandestine way in which these photographs were taken was particularly shocking to us as it breached our privacy."
He also said that the fact that the photographs had been taken were "all the more painful" in light of his mother's death and the harassment she had experienced.
Agency photographers Cyril Moreau, Dominique Jacovides and La Provence's Valerie Suau were all convicted on charges of invasion of privacy and complicity.
Suau took the photographs and but told the court she did not intend to breach the privacy of the royal couple.
The court also heard that mobile phone data placed the other two photographers, Moreau, 32, and Jacovides, 59, in the area near the chateau at the start of September 2012.
The pair both pleaded not guilty but were convicted.
Laurence Pieau, the editor of Closer magazine in France, was also found guilty of complicity.
Ernesto Mauri, chief executive of publishing group Mondadori, was convicted of one charge of using a document obtained by breach of privacy.
Marc Auburtin was the publishing director of the magazine at the time and was convicted of the same charge.
On September 5, 2017 — almost five years to the day since the pictures were taken — the judge presiding over the case awarded Kate and William damages of 103,000 Euros.
At the time the figure was equivalent to £94,000 but since then the pound has weakened against the euro.
Fines were imposed on newspaper bosses and photographers for invading the Duchess's privacy.
The royal couple had launched their legal proceedings in 2012, with a court banning Closer from printing any further images.
That decision was later appealed by Closer's lawyers after sexy snaps and a video of Meghan Markle , 36, emerged, which were taken before she married Prince Harry.
They claimed the images of the former Suits actress prove royals are "happy with sexy photos".
One legal source said: “They’re happy with sexy photos of themselves when they’re in control, but claim huge amounts if they’re unauthorised.
"There’s ridiculous hypocrisy involved.”
In lodging the appeal, Paul-Albert Iweins, for Closer, argued that the court’s decision last year was “consistent with case law” but that the damages awarded were “exaggerated for a simple matter of privacy”.
Among images that were shown in the appeal were sequences from a 2013 video Meghan shot for Men’s Health Magazine.
But the appeal was rejected by a court on 19 September 2018 meaning Closer now had to pay the damages.
Ernesto Mauri, chief executive of publishing group Mondadori, which produces Closer, and Laurence Pieau, editor of the magazine in France, were fined the maximum penalty of 45,000 euros.
The decision to fine two photographers, who photographed the duchess, 10,000 euros each was also upheld.

Kate Middleton is one of the most influential style icons of our time. But being fashionable and stylish is not the only reason why millions of women look up to the Duchess of Cambridge. With her humble nature and poise, Kate embodies a classically effortless style, unpretentious beauty and unmatched grace. On top of all that, Kate is confident in her body.
The paparazzi never seem to leave her alone. In fact, photographers and the paparazzi have constantly been on Kate's tail ever since she married Prince William in a posh ceremony in 2011. Though Kate Middleton is a super-conservative dresser, even she has been caught in the nude by photographers (and it's not surprising considering the paparazzi's wild obsession with the Duchess of Cambridge!).
Furthermore, despite the conservatism, poise, and grace, Kate is still prone to a wardrobe malfunction (or two). Over the years, Kate has fallen victim to wardrobe mishaps and near-nip-slips quite a few times, revealing more skin than she intended (or is royally-acceptable!).
In fact, Kate was even in the center of a topless photo scandal stemming from 2012 .
In 2017, a judge ordered French magazine Closer to pay the royals $118,000 in damages and imposed a fine of $53,000 against two magazine executives each for publishing several nude photos of Kate Middleton taken during her vacation in Provence, France. The scandalous photos, taken by a prying French paparazzo—equipped with a long-range lens camera from a public road half a mile away—show Kate not only topless but also without her bikini bottoms on.
Even Donald Trump himself, who wasn’t the President at the time, reacted to Kate Middleton’s nude photos scandal. In 2017, Us Weekly dug out 2012 tweets of the then-television personality, in which Trump defended a paparazzo who took photographs of naked Kate, and said the Duchess was the one to blame. “She shouldn’t be sunbathing in the nude,” President Trump argued in the resurfaced tweets .
Though Kensington Palace certainly isn't happy about it, Kate Middleton's naked photos are not exactly non-existent. Far from it! OK! Magazine uncovered some of that will certainly cause Queen Elizabeth to spill her tea.
Six years before the infamous topless photos scandal set the media on fire, Kate Middleton put her bikini body on full display during her vacation with Prince William in Ibiza. Kate and William’s relationship had recently been announced, so the nudity-hungry paparazzi were stalking the lovebirds like crazy. Not that Kate cared much. What a badass!
Years before Kate became a royal, she didn’t mind baring lots of skin in the chest area. While the Duchess of Cambridge might not be able to go braless or flash flesh in skin-baring outfits as a royal too often, it seems that Kate still carries herself with the same poise as before – which in itself is surprisingly sexy.
Kate showed some major cleavage as she sat cross-legged on the grass.
Kate is not too princessy to play sports! Even if it means getting a little wet and showing off your toned back and butt to the paparazzi.
A little party never killed nobody! It may be difficult to imagine Kate in an outfit like this, let alone see her in one, but those wild partying days are not something to be ashamed of (girls just wanna have fun!).
Nothing to see here—except a photo of Kate looking breathtakingly beautiful. Oh, and a little dress mishap thanks to a gust of wind. But Kate obviously handled this minor wardrobe malfunction with her signature grace and poise.
Kate should have known better than to squat down in a dress in front of hundreds of eagle-eyed paparazzi. This photo (and angle) came ridiculously close to becoming her grandmother-in-law Queen Elizabeth’s worst nightmare.
When you are a royal who doesn’t expose much skin (ever), even a tiny glimpse of your bare midriff can cause an uproar from onlookers and the paparazzi. And it did.
Kate Middleton wore this iconic Charlotte Todd dress on the catwalk at St. Andrew’s University Charity Show in 2002. The dress was put up for auction in 2011, and a glimpse of Kate strutting in risqué see-through dress can be seen just behind the mannequin.
If the wind could speak, it would say “Gotcha, again!” It was a close call as Kate and her hubby, Duke of Cambridge Prince William, landed in New Zealand in 2014. Once again, Kate’s dress stood no chance against the wind.
Kate struggled to maintain her modesty at a charity forum in London in 2013, and the wind was once again to blame for exposing the Duchess of Cambridge’s legs. Strong winds seem to follow Kate wherever she goes and wherever she winds up (pun intended).
In fact, it was reported that after this particular wardrobe malfunction, Queen Elizabeth allegedly demanded Kate to ditch short skirts and wear outfits with lower hemlines. But Kate is a rebel, so she didn’t listen (at all)—because no one should tell a woman what to do (even if it’s Queen of the England).

Catherine, Duchess of Cambridge, aka Kate Middleton, was a mousy bookworm at age 16 in 1998 until she decided it was time to emerge from her mild-mannered cocoon.
Wanting to be noticed while attending Marlborough College, a boarding school in Marlborough, Wilshire, England, she opened her second-story dorm window and flashed her nude bum to male students in view.
Cheers from the grateful crowd encouraged her mooning and it evolved into an obsession she took great pride in and earned her the moniker of 'Kate Middlebum'.
'She kind of got addicted to it,' her close schoolmate, Jessica Hay stated. Over the course of one year, she put her bare bum in the window for anyone to see no less than 90 times.
While she was quickly coming out of that shy cocoon, she didn't have her first lover yet, Christopher Andersen writes in Game of Crowns: Elizabeth, Camilla, Kate and the Throne, published by Gallery Books.
What a transformation! Kate Middleton went from a gawky kid to a stunning woman. At 20, Kate knew how to dress to impress - men. She wanted to be noticed while attending Marlborough College, a boarding school in Wilshire, England, so she flashed her nude bum to any male students in view
Coupling: When she met William at St Andrews their first encounter was 'awkward and mercifully brief' but before long they became friends and then flatmates
Steamy: Williams was watching when Kate modeled on catwalk at student fashion show with Fergus Boyd, both flatmates of the prince at St Andrews
Kate met Prince William three years later in 2001. The encounter was 'awkward and mercifully brief' at their dormitory at St. Andrews, the oldest university in Scotland, which they both attended.
She 'turned bright red and sort of scuttled off, feeling very shy about meeting him', Kate recalled.
He was the very reason she was there: to meet, and with any luck, to marry the future monarch, Andersen writes.
Kate had harbored a crush on Princess Diana's oldest son for years and displayed a color photo of him with his father, Prince Charles, in her bedroom at Marlborough College, says the author.
She tracked Will's royal schedule, read every newspaper and magazine story including every gossip item.
'You cannot tell me anything about Prince William that I don't already know,' she told a schoolmate.
Like mother, like daughter: Kate's mother, Carole Goldsmith was six years older than Diana, and her youthful fixation was on William's father, Charles, the Prince of Wales.
But there wasn't even a remote chance their paths would ever cross.
Growing up, Carole's family moved from a cramped, unheated flat in London's downscale Southall to a larger house in the nearby area of Ealing, decidedly more affluent but not any closer to her fantasy Prince.

Jealous? Kate and William had split when this picture of Kate with an unknown friend was taken at a performance at Wembley stadium in 2007
She had neither the means nor the desire to attend college and joined the British Airlines flight attendant program right out of high school in 1974.
She met Mike Middleton, head of ground operations at Heathrow Airport, and they married in 1980.
Lest those princely fantasies evaporate, she transferred them to her daughter, Catherine who was born on January 9, 1982, six months before Prince William's birth on June 21 that same year.
With luck and hard work, the Middletons mail-order business, Party Pieces, that created anything one would need for a proper children's party, gave them the income to move even closer to fulfilling that princely fantasy for their daughter.
They now had the money to send Catherine to a private school - where there might be a prince in residence.
When she was seven she was enrolled at St. Andrew's School in the nearby town of Pangbourne.
Kate was great at sports as well as academics and at that age expressed a fondness for dressing up. She sang the lead in the school's musical productions.
At thirteen, Kate was enrolled in Downe House, an all-girls boarding school in the town of Cold Ash, Berkshire, near the Middleton home.
She was a gawky, skinny kid. She was bullied, and when it didn't stop, her mother transferred Kate to Marlborough College, her first co-ed school experience.
'Her looks were judged a '2' on a scale of 1 to 10 by a group of tittering adolescent boys - from the moment she walked into the school's dining hall'.
While at Marlborough, Kate was reading those tabloid stories about all the eligible young women circling the future king. That event included a schoolmate of Kate's.
