DALLAS — Top Republican leaders in Texas this week weighed in on two parents’ custody battle over their 7-year-old child’s gender identity after the case was shared widely on social media and conservative news sites.
Former spouses Anne Georgulas and Jeffrey Younger, who live in the Dallas area, have been embroiled in a legal dispute over their divorce and the care of their children since 2015. And recently, inaccurate and misleading stories about the 7-year-old — who was born a boy but whom the mother says identifies as a girl — have circulated in blogs, Facebook posts, YouTube videos and petitions, bringing attention to a usually private matter. The father asked to be the parent who makes decisions about the child following a disagreement over how to raise the child.
The Associated Press is not naming the 7-year-old to protect the child’s privacy.
Gov. Greg Abbott tweeted Wednesday evening that the attorney general’s office and Texas Department of Family and Protective Services were looking into “the matter” of the child. And on Thursday, Attorney General Ken Paxton said he was asking Family and Protective Services to investigate for possible child abuse.
However, Judge Kim Cooks in Dallas said Thursday during a hearing that the court noted no abuse, neglect or family violence in the case. She said the parents would continue to share custody and would make joint decisions about the child.
The judge scolded the father, who she noted was unemployed, for seeking publicity on the case and raising money on his website, but she also pointed out how the mother testified that her encouragement of the child being transgender may have been excessive.
“The father finds comfort in public controversy and attention surrounded by his use of unfounded facts and is thus motivated by financial gain,” Cooks said, adding that the gain came “at the cost of the protection and the privacy of the children.”
Much of the public reaction to the case has focused on backing the father’s narrative. On his website, he pleads for help to “save” his child, with a headline saying he’s fighting “chemical castration and sex-change of his son.”
A post of a woman holding a baby shared widely on Facebook targets the mother, saying she “always wanted a girl.”
Cooks said Thursday that no Texas court or judge has ordered “the chemical castration, puberty blockers or any transgender reassignment surgery on this child to become female.”
Attorneys for Georgulas, who is a pediatrician, said before the hearing that she was “being viciously attacked and threatened by complete strangers based on false and untrue statements.” Cooks said she limited spectators to only the media at the hearing because of safety concerns.
Earlier this month, Georgulas filed a proposed parenting plan that said the child isn’t yet at an age where treatment with hormonal suppression, puberty blockers or transgendered reassignment surgery is considered. And she asked the court to not allow any such treatment without the consent of both parents.
Dr. Stephen Rosenthal, medical director for the University of California San Francisco’s Child and Adolescent Gender Center, says that often when parents disagree about potential treatment it’s “likely because there’s a possibility that they may be misinformed about what the treatment actually is” or if medical treatment would even be considered at the child’s age.
He said a puberty blocker temporarily puts puberty on pause and is a safe medication that has most commonly been given to kids who go into puberty much too early. He said that before the onset of puberty, there’s “no role” for medical intervention in a person who might be transgender.
Rosenthal added that not every child who identifies as transgender before puberty will continue in identifying that way after it starts.
Cooks said the court found that both parents love their children, and she noted the 7-year-old appears comfortable as a male or female.
Younger told the AP before Thursday’s hearing that the child identifies as a boy when at his house.
Asked after the hearing if he was happy with the outcome, Younger didn’t comment and only smiled and nodded.

A judge in Texas granted full custody of a nine-year-old boy to his mother, who for the past several years has sought to force the child to be transgender despite protests by the boy’s father.
Anne Georgulas, a pediatrician in Coppell, Texas, was granted full custody on Tuesday to James Younger, her son, by Democrat Judge Mary Brown. Georgulas will assume full responsibility for the boy’s medications, extracurricular activities, education, primary residence, and counseling. The ruling also permits the mother to withhold information regarding Younger’s ” …extracurricular activities, school functions, school enrollment, counseling, and medical care” from the father, Jeff Younger.
Georgulas and her ex-husband have sparred in the public eye over their son’s sex. Georgulas refers to James as “Luna,” and believes the biological boy to be a female. Younger disagrees, saying James chooses to present himself as a boy at his house, even though he keeps feminine clothes in his son’s closet as an option.
The Facebook page “Save James,” which has eclipsed a following of close to 39,000 people since launching years back, denounced the memorandum last Wednesday.
“Judge Mary Brown ruled against the safety and protection of James and Jude,” the page wrote. “Supervised visitation with their own dad at Jeff’s expense. As of today, no communication with their beloved daddy! Dr. Fletcher’s dishonest report has prompted Anne to file an Ex Parte Temporary Restraining order to prevent Jeff from seeing or even speaking with his sons. The child abusers say James and Jude are afraid of Jeff! PRAY!”
While Georgulas was given custody, there are limitations in place. Although she is granted the ability to consent to medical procedures, hormone-suppression therapy, puberty blockers, and “reassignment surgery,” or gender mutilation, are not included in this umbrella. The mother argues that her son expressed a desire to be called Luna but Jeff claims to have footage disproving this claim.
“The prior orders that Ms. Georgulas must notify Mr. Younger of doctor’s, counseling, or mental health appointments, or extracurricular activities for the children are lifted,” the court document states. “In an effort to ensure the emotional well-being and physical safety of the children, the court orders that all of Mr. Younger’s possession periods shall be continuously supervised by Forensic Counseling Services. …at Mr. Younger’s sole cost and expense.”
In a hearing a month ago, Georgulas claimed her son’s sex was not the primary force behind the custody case. She accused Jeff of bad “parenting abilities,” which evidently succeeded given that the court found Jeff “failed to timely make the payments of child support, medical support and interest as ordered and only paid his past due support after the motion for enforcement was filed.”
Jeff’s attorney, however, argued that Georgulas’ team seeks to “downplay” the significance of the trans-issue.
“To downplay that this is but for the gender issue is absolutely misleading and wrong,” attorney David Hanschen said. “This is all about the gender issue in this case. And it’s about the parents’ ability to cope with and deal with this situation.”
A jury in Dallas ruled 11 to 1 in October 2019 to not grant Jeff sole conservatorship of James and his brother. Georgulas then filed a petition in court to try and mandate her ex-husband refer to their son as a female. Republicans in Texas introduced a measure in May to prohibit child sex mutilation, but it failed and was not scheduled in the House.

A mother from Texas who was attempting to medically transition her seven-year-old son into a girl has lost a court case.
Dr. Anne Georgulas, who is the mother of James Younger, originally won her previous court case last October that allow her to give him hormones that block puberty.
