The President introduces three key initiatives to develop business environment in Uzbekistan 

On August 18, 2023 the President held an open dialogue with entrepreneurs,  outlining three pivotal directions to enhance Uzbekistan’s business landscape:

• Initiatives related to medium-sized business

An industrial mortgage system and offer entrepreneurs ready-made business premises will be introduced for business activities. Furthermore, a minimum of three new industrial zones will be established in each region.

• Entering new markets with competitive products

Initiated last year the program “New Uzbekistan - Land of Competitive Products”  will be continued. It introduces special credit, tax, and customs regimes for 500 leading exporting companies (previously 100). The President also emphasized attracting prestigious foreign brands and implementing international standards, environmental requirements, and production certifications.

• Simplifying tax administration and eliminating bureaucracy

The President announced abolishment of tax gap practice and review of all financial sanctions, followed by the establishment of fair norms. Additionally, starting January 1, 2024, duplicate and outdated reports will be eliminated in favor of a unified electronic reporting system.

18 августа 2023 года Президент провел открытый диалог с предпринимателями, обозначив три важных направления для улучшения деловой среды Узбекистана:

• Инициативы, связанные с средним бизнесом

Планируется внедрение системы промышленных ипотек и предложений предпринимателям готовых деловых помещений для осуществления предпринимательской деятельности. Кроме того, в каждом регионе будет создано не менее трех новых промышленных зон.

• Выход на новые рынки с конкурентоспособной продукцией

Начатая в прошлом году программа “Новый Узбекистан - страна конкурентоспособной продукции” будет продолжена. Она предусматривает специальные кредитные, налоговые и таможенные режимы для 500 ведущих экспортных компаний (ранее 100). Президент также подчеркнул привлечение престижных зарубежных брендов и внедрение международных стандартов, требований к охране окружающей среды и сертификации продукции.

• Упрощение налогового администрирования и ликвидация бюрократии

Президент объявил об отмене практики налогового разрыва и пересмотре всех финансовых санкций с последующим установлением справедливых норм. Кроме того, с 1 января 2024 года дублирующиеся и устаревшие отчеты будут устранены в пользу единой электронной системы отчетности.

Legislative amendments approved to align with WTO agreements

The Cabinet of Ministers has issued a Resolution introducing changes to the legal normative acts to harmonize legal framework with international agreements of the World Trade Organisation. 

According to these amendments, legal consultants listed in the register of legal consultants will now be permitted to provide advice on international law and laws of foreign countries.

Additionally, amendments are envisaged in the procedure for product labeling. According to the amendments, importers, as well as authorized representatives of manufacturers, will be obliged to label consumer goods in the state language. Previously, this requirement applied exclusively to manufacturers.

The amendments will come into effect on January 1, 2024.

Утверждены изменения в законодательство для гармонизации с соглашениями ВТО

Кабинет министров принял постановление о внесении изменений в нормативные правовые акты для согласования правовой базы с международными соглашениями, связанными с Всемирной торговой организацией.

Согласно изменениям, юридические консультанты, включенные в реестр юридических консультантов, могут консультировать по международному праву и праву зарубежных стран. 

Также, предусматриваются изменения в порядок маркировки товаров. Согласно изменениям импортеры, а также уполномоченные представители производителей, будут обязаны проставлять маркировку на государственном языке на потребительские товары. Ранее данное требование распространялось исключительно на производителей.

Изменения вступают в силу с 1 января 2024 года. 

Senate approved amendments to currency regulation, Leasing, and Rental Laws

During a plenary session, the Senate approved a Draft Law aimed at improving currency regulation, leasing, and rental relations (the “Draft Law”). 

Among the key changes, the Draft Law introduces the concept of a lease agreement with an option to purchase, establishing clear rules and obligations for lessors and lessees.

Additionally, the Draft Law includes new provisions related to currency regulation. Thus new provisions exempt businesses from penalties for non-repatriation of assets within the framework of export contracts.

Also,the Draft Law introduces a provision under which the object of the agreement is deemed to be pledged to the lessee as security for the fulfillment of an obligation under the agreement.

Сенат одобрил изменения в валютное регулирование, а также в законы об аренде и лизинге

В ходе пленарного заседания Сенат одобрил Законопроект, направленный на совершенствование валютного регулирования, арендных и лизинговых отношений (“Законопроект”). 

Среди ключевых изменений, Законопроект внедряет понятие договора аренды с условием последующего выкупа, устанавливая четкие правила и обязательства для арендодателей и арендаторов. 

Также Законопроект предусматривает новые положения по лизингу и валютному регулированию. Таким образом планируется указание возможности о приобретении объекта лизинга в собственность и  освобождение от уплаты штрафа за необеспечение репатриации активов в рамках экспортного контракта. 

The state shares in major enterprises have been transferred to the Ministry of Economy and Finance

The President signed a Resolution amending the mechanism for reforming state-owned enterprises. 

According to the Resolution, the state shareholdings in the charter capital of major state-owned enterprises are to be transferred from the investment company UzAssets to the Ministry of Finance and Economy. 

Dividends from these shareholdings will be allocated to the Fund for Reconstruction and Development.

Государственные пакеты акций в крупных государственных предприятиях переданы Министерству экономики и финансов

Президент подписал Постановление об изменении механизма реформирования государственных предприятий. 

Согласно Постановлению государственные пакеты акций в уставном капитале крупных государственных предприятий должны быть переданы от инвестиционной компании UzAssets к Министерству финансов и экономики. 

Дивиденды по пакетам акций будут переведены Фонду реконструкции и развития.

List of job and positions with material responsibility

A List of jobs and positions requiring the conclusion of a written contract of full material responsibility has been approved by the Order of the Minister of Employment and Poverty Reduction. 

The list includes 177 positions and types of work with employees for whom written contracts of full material responsibility can be concluded (specialists in the pharmaceutical field, chemical engineers, as well as workers in the fields of trade, banking, postal services, delivery, and other specialists).

Перечень материально ответственных должностей и работ

Приказом Министра занятости и сокращения бедности утвержден примерный перечень должностей и работ, требующих заключения письменного договора о полной материальной ответственности. 

В перечне указаны 177 должностей и видов работ с работниками которых могут быть заключены письменные договоры о полной материальной ответственности (специалисты в сфере фармацевтики, инженеры-химики, а также работники в сфере торговли, банковской деятельности, почты и доставки, и другие специалисты).

Online Certification for Environmental Auditors

The Cabinet of Ministers approved an administrative regulation to streamline the process of obtaining a qualification certificate for environmental auditors, as well as the procedure for maintaining the register of environmental audit organizations. 

Candidates seeking the certificate must have a higher education degree in the field of ecology and environmental protection, as well as three years of work experience in this area.

The certificate can be obtained by submitting an application to the Center of Public Services or online through Single Portal of Interactive Public Services. 

The processing fee for the application is 1 BCU (equivalent to UZS 330,000 or approximately USD 27).

Получение сертификата экологического аудитора онлайн

Кабинет министров утвердил административный регламент оказания государственных услуг по выдаче квалификационного сертификата экологического аудитора, а также порядок ведения реестра экологических аудиторских организаций. 

Для получения сертификата кандидатам необходимо иметь высшее образование в области экологии и охраны окружающей среды, а также трехлетний опыт работы в данной сфере.

Получение сертификата осуществляется посредством подачи заявления в Центр государственных услуг или онлайн посредством Единого портала интерактивных государственных услуг. Плата за рассмотрение составляет 1 БРВ (330 000 сум, или приблизительно 27 долларов США)
