Normative legal acts will undergo anti-corruption expertise
The President has signed the Law on the Anti-corruption Expertise of Normative Legal Acts and Their Drafts (the “Law”). Anti-corruption expertise refers to a set of measures aimed at identifying corruption-related factors in normative legal acts and their drafts, along with the development of recommendations and the implementation of measures to eliminate such factors.
The Law outlines the procedure for conducting anti-corruption expertise of normative legal acts and their drafts, as well as the content of conclusions drawn based on the results of the expertise.
The Cabinet of Ministers is instructed to bring government decisions in line with the new Law, ensure the review and repeal of normative legal acts by executive authorities that contradict the Law.
Нормативно-правовые акты будут проходить антикоррупционную экспертизу
Президент подписал Закон об антикоррупционной экспертизе нормативно-правовых актов и их проектов (“Закон”). Под антикоррупционной экспертизой понимается комплекс мероприятий, направленный на выявление коррупциогенных факторов в нормативных актах и их проектах, с разработкой рекомендаций и принятием мер, направленных на устранение таких факторов.
В Законе прописаны порядок проведения антикоррупционной экспертизы нормативных актов и их проектов, а также содержание заключений, составленных по результатам экспертизы.
Кабинету министров поручено привести решения правительства в соответствие с новым Законом, обеспечить пересмотр и отмену органами исполнительной власти их нормативно-правовых актов, противоречащих Закону.
Simplified requirements to obtain an attorney's license
The President has approved the following amendments to the Law on Advocacy regarding the requirements for obtaining an attorney's license:
- The requirement for a two-year experience in legal profession is abolished, and
- The requirement for the duration of internship in an advocacy structure is reduced from 6 to 3 months.
Упрощены требования для получения лицензии адвоката
Президент утвердил следующие изменения в Законе об адвокатуре в части требований для получения адвокатской лицензии:
- отменяется требование о двухлетнем стаже по юридической специальности; и
- сокращается требование о сроке прохождения стажировки в адвокатском формировании с 6 до 3 месяцев.
Таким образом, теперь для получения лицензии адвоката необходимо пройти трехмесячную стажировку в адвокатском бюро, адвокатской фирме, коллегии адвокатов или юридической консультации и сдать квалификационный экзамен.
A simplified procedure for the voluntary liquidation of business entities has been introduced
The new Resolution of the Cabinet of Ministers has introduced changes to the process of voluntary liquidation and cessation of activities of business entities, as well as the removal of entities not engaged in financial and economic activities from the state registry (the "Resolution").
According to the Resolution, henceforth, during the process of voluntary liquidation, business entities will no longer be required to submit the following documents to the registering authority:
- a certificate indicating the closure of their bank account (this information will be provided by the bank),
- seals and stamps.
Упрощен порядок добровольной ликвидации субъектов предпринимательства
Новым Постановлением Кабинета Министров были внесены изменения в порядок добровольной ликвидации и прекращения деятельности субъектов предпринимательства и исключения из государственного реестра лиц, не осуществляющих финансово-хозяйственную деятельность (“Постановление”).
В соответствии с Постановлением отныне при добровольной ликвидации субъекты предпринимательства не будут предоставлять регистрирующему органу следующие документы:
- справку о закрытии счета (данная информация предоставляется банком);
- свои печати и штампы.
The model regulation for employment procedures has been approved
By the order of the Minister of Employment and Poverty Reduction, a model regulation for conducting selection during the hiring process has been established (the “Model Regulation”).
The Model Regulation outlines the procedures for organizing the activities of the employment selection committee, the stages of the selection, and the procedure for candidates to appeal the selection results. Please be advised that this document is of a recommendatory nature and can be applied within enterprises regardless of the ownership structure.
Утверждено типовое положение о приеме на работу
Приказом министра занятости и сокращения бедности населения было утверждено типовое положение о проведении конкурса при приеме на работу (“Типовое положение”).
Типовое положение определяет порядок организации деятельности комиссии по приему на работу, этапы конкурса, и порядок апелляции кандидатами результатов конкурса. Обращаем внимание, что документ носит рекомендательных характер и может быть применен в предприятиях независимо от формы собственности.
A registry for mandatory requirements in the field of entrepreneurship is underway
According to the Resolution of the Cabinet of Ministers, starting from December 1, 2023, a unified electronic registry of mandatory requirements in the field of entrepreneurship will begin its operation on a trial basis (the "Registry").
The Registry will encompass all regulations governing entrepreneurial activities, their deadlines, associated financial expenditures, documents confirming compliance with requirements, regulatory authorities, inspection procedures, and liability measures.
Вводится реестр обязательных требований в сфере предпринимательства
Согласно Постановлению Кабинета Министров, с 1 декабря 2023 года в тестовом порядке начнет работать единый электронный реестр обязательных требований в сфере предпринимательства (“Реестр”).
Реестр будет включать в себя все нормы по регулированию предпринимательской деятельности, их сроки, связанные с ними финансовые расходы, документы, подтверждающие соответствие требованиям, контролирующие органы, формы проверок и меры ответственности.
Digitalization of agriculture
The President has signed a Resolution outlining measures for the implementation of advanced digital technologies in the agricultural sector. Thus, starting from September 1, 2023, the "Agroplatform" information system (the "Information System") will be introduced.
The new Information System will facilitate the transition to a digital format for providing preferential loans for the cultivation of cotton, grains, fruits, and vegetables, as well as for delivering agricultural services.
Цифровизация сельского хозяйства
Президент подписал Постановление о мерах по внедрению передовых цифровых технологий в сферу сельского хозяйства. Так, с 1 сентября 2023 года внедряется информационная система «Агроплатформа» (“Информационная система”).
Новая Информационная система позволит перевести в цифровой формат выдачу льготных кредитов для выращивания хлопка, зерна, фруктов и овощей, а также оказание сельскохозяйственных услуг.
