Changes in the Rules on Certification

On May 15, 2023, the Order on Amendments to the Products Certification Rules сame into force (the “Order”). According to the Order, the application for certification of products will also be investigated and checked for compliance with intellectual property rights (trademarks, service marks, appellations of origin, geographical designations and industrial designs) (the “Intellectual property”).

In the case of identity and similarity to the extent of confusion of the Intellectual property with other objects protected by law, certification bodies may refuse the application for products certification.

Examination and verification of compliance with intellectual property rights is carried out according to the Scheme approved in the Order.

Изменения в Правилах сертификации

15 мая 2023 года вступил в силу Приказ о внесении изменений в Правила сертификации продукции (“Приказ”). Согласно Приказу, заявление на сертификацию продукции также будет изучаться и проверяться на соответствие правам интеллектуальной собственности (товарные знаки, знаки обслуживания, наименования мест происхождения товаров, географические указания и промышленные образцы) (“Интеллектуальная собственность”). 

В случае идентичности и сходства до степени смешения Интеллектуальной собственности с другими объектами, охраняемыми законодательством, органы по сертификации могут отклонить заявление на сертификацию продукции.

Изучение и проверка соблюдения прав на объекты интеллектуальной собственности проводится по схеме, утвержденной в Приказе.

Procedure for licensing the activity of payment system operators and payment organizations

The Central Bank approved the Regulation, which determines the requirements, conditions and procedures for obtaining (reissuance/suspension/withdrawal) of licenses of payment system operators and payment organizations. 

The founders (participants or shareholders) of the payment system operators or payment organizations can be both residents and non-residents (natural persons and legal entities) of the Republic of Uzbekistan, with the total share of the latter in the charter capital not exceeding 50% (there are some exceptions).

The act will come into force in August 2023.

Порядок лицензирования деятельности операторов платежной системы и платежных организаций

Центральный банк утвердил Положение, определяющее требования, условия и процедуры получения (переоформления/приостановления/отзыва) лицензии оператора платежной системы и лицензии платежной организации. 

Учредителями (участниками или акционерами) оператора платежной системы или платежной организации могут быть как резиденты Республики Узбекистан, так и нерезиденты (физические и юридические лица); при этом суммарная доля последних в уставном фонде не должна превышать 50% (есть исключения).

Акт вступит в силу в августе 2023 года.

Reforms in the sphere of digital technologies 

The Presidential Decree establishes measures for the effective organization of public administration in the field of digital technology. 

According to the Decree, the following functions of the Ministry of Digital Technologies will be transferred to the private sector from January 1, 2024:

• developing project and estimate documentation for the construction of buildings, structures and other facilities in the field of communications,
• designing local, long-distance and international communication networks.

Реформы в сфере цифровых технологий 

Указом Президента устанавливаются меры по эффективной организации государственного управления в сфере цифровых технологий. 

Согласно Указу, с 1 января 2024 года следующие функции Министерства цифровых технологий будут переданы частному сектору:

• разработка проектно-сметной документации на строительство зданий, сооружений и других объектов в сфере связи;
• проектирование местных, междугородних и международных сетей связи.

Green energy certificates

According to the Presidential Decree, a system of “green energy” certificates confirming production of electricity using renewable energy sources will be introduced in stages:

• from July 1, 2023 - for electricity generated at hydroelectric power plants of Uzbekhydroenergo JSC;
• from October 1, 2023 - for electricity generated by solar, wind and hydroelectric power plants, etc.

One "green energy" certificate confirms generation of 1,000 kWh of electricity. When determining the income tax base, the cost of green energy certificates is treated as a deductible expense.

Сертификаты “зеленой энергии”

Согласно Постановлению Президента, поэтапно внедряется система сертификатов «зеленой энергии», подтверждающих выработку электроэнергии с использованием возобновляемых источников энергии:

• с 1 июля 2023 года — для электроэнергии, выработанной на гидроэлектростанциях системы АО «Узбекгидроэнерго»;
• с 1 октября 2023 года — для электроэнергии, выработанной на солнечных, ветровых и гидроэлектростанциях, и др.

Один сертификат «зеленой энергии» подтверждает выработку 1,000 кВт*час электроэнергии. При определении базы налога на прибыль расходы на приобретение сертификатов «зеленой энергии» относятся к вычитаемым расходам.

The President has signed the Law on Restricting the Distribution and Consumption of Alcoholic and Tobacco Products

The new Law prohibits the realization of alcohol and tobacco products to persons under 21 years old, sale through vending machines, in the form of electronic commerce, through traveling sales, etc.

Also, the Law establishes the requirements for production, packaging and labeling, wholesale and retail trade, and import of alcohol and tobacco products.

The effective date of the Law is August 2023.

Президент подписал Закон об ограничении распространения и употребления алкогольной и табачной продукции

Новым Законом запрещена реализация алкогольной и табачной продукции лицам, не достигшим 21 года, реализация посредством торговых автоматов, в форме электронной коммерции, путем выездной торговли, и др.

Также, Закон устанавливает требования к производству, упаковке и маркировке, оптовой и розничной торговле, и импорту алкогольной и табачной продукции.

Дата вступления в силу Закона - август 2023 года.

Legal entities will be able to pay for Internet advertising from corporate cards

A Resolution of the Cabinet of Ministers has been adopted, according to which starting from July 1, 2023 companies will be able to pay for advertising costs in foreign social networks via their corporate cards in foreign currency. The maximum amount is USD 5,000 per calendar month.

Information on these payments must be entered into the unified electronic information system of foreign trade transactions (UEISFTT).

Юридические лица смогут оплачивать интернет-рекламу с корпоративных карт

Принято постановление Кабинета Министров, согласно которому с 1 июля 2023 года компании смогут выполнять расчеты по расходам на рекламу в иностранных социальных сетях с корпоративной карты в иностранной валюте. Максимальная сумма — 5,000 долларов США в календарный месяц.

Сведения о данных платежах необходимо вносить в единую электронную информационную систему внешнеторговых операций (ЕИСВО).
