President approved the new Labor Code
The new Code introduces the principle of social partnership and new terms, such as “paid internship”, “remote work” and “internal investigation”.
Among others, the new Code:
- establishes the invitation-to-work process,
- expands compulsory conditions of the employment contract,
- establishes grounds and the maximum duration of a fixed-term employment contract,
- introduces conditions for application of a 6-month probation period,
- increases the minimum duration of annual leave,
- approves the procedure for a secondment of an employee,
- determines the procedure for mass layoff of employees.
The Labor Code shall come into force on April 30, 2023.
Президент утвердил новый Трудовой кодекс
Новый Кодекс вводит принцип социального партнерства и такие понятия как “стажировка”, “удаленная работа” и “служебное расследование”.
Помимо прочего, новый Кодекс:
- утверждает процесс приглашения на работу;
- расширяет обязательные условия трудового договора;
- определяет основания заключения и максимальную продолжительность срочного трудового договора;
- вводит условия 6-месячного испытательного срока;
- увеличивает минимальную продолжительность трудового отпуска;
- утверждает порядок прикомандирования работника;
- определяет порядок массового высвобождения работников.
Трудовой кодекс вступает в силу с 30 апреля 2023 года.
Legislative Chamber adopted a Law on Conflict of Interests
According to the Law, decisions made with the assumption of a conflict of interest must be changed or cancelled. In case of a conflict of interest, state bodies shall cover the caused damage and restore public trust.
Failure to notify about the existence of a conflict of interest will be punishable by a fine of 3 to 5 BCU (approximately UZS 900 000 - 1 500 000 or USD 80 - 134), failure to take action to resolve - 5 to 10 BCU (approximately UZS 1 500 000 - 3 000 000 or USD 134 - 269). The Anti-corruption Agency is determined as the authorized body in the sphere of regulating the conflict of interest.
The Law has to be considered by the Senate.
Законодательная палата приняла закон о конфликте интересов
Согласно закону, решения, принятые с допущением конфликта интересов, должны быть изменены или отменены. В результате конфликта интересов государственным организациям необходимо покрыть нанесенный ущерб и восстановить доверие населения.
Несообщение о конфликте интересов наказывается штрафом от 3 до 5 БРВ (приблизительно 900 000 - 1 500 000 сум или 80 - 134 дол.США), непринятие мер по урегулированию - от 5 до 10 БРВ (приблизительно 1 500 000 - 3 000 000 сум или 134 - 269 дол.США). Уполномоченным органом по регулированию конфликта интересов определено Агентство по противодействию коррупции.
Закон передан на рассмотрение Сенату.
Discussion of additional measures for protection of businesses was completed
The business ombudsman brought up for discussion a draft law, which aims to improve the legal protection of business entities.
The draft law envisages, among others, the following:
- imposing a three-year moratorium on the introduction of new types of liabilities and penalties for entrepreneurs,
- decriminalization of criminal liability for violation of trade rules,
- reduction of financial sanctions and etc.
The draft law has to be considered by the Oliy Majlis.
Обсуждены дополнительные меры по защите бизнеса
Бизнес-омбудсменом вынесен на обсуждение законопроект об усилении правовой защиты субъектов предпринимательства.
Законопроектом предусматривается, среди прочего:
- введение трехлетнего моратория на введение новых видов ответственности и наказаний для предпринимателей;
- декриминализация уголовной ответственности за нарушение правил торговли;
- уменьшение финансовый санкций и другое.
Законопроект передан на рассмотрение в Олий Мажлис.
The Presidential Resolution expands list of activities for self-employed
Starting from November 1, 2022, self-employed individuals are able to engage in intermediary services in car markets, real estate services, rental of household goods, craft activity and etc.
Постановлением Президента расширен перечень видов деятельности для самозанятых
С 1 ноября 2022 года самозанятые могут заниматься посредническими услугами на авторынке, риэлторской деятельностью, арендой бытовых товаров, ремесленной деятельностью и т.д.
Confirmation of force majeure will be issued through the Single Portal of Interactive Public Services
The Cabinet of Ministers adopted procedure for providing state services for confirming a force majeure on foreign trade transactions, international, financial, and investment agreements.
Force majeure certificate will be verified by E-signature and issued within 13 working days. The Ministry of Investment and Foreign Trade is appointed as the authorized state body.
The Resolution will come into force on December 30, 2022.
Форс-мажор будет подтверждаться посредством Единого портала интерактивных государственных услуг
Кабинет министров утвердил порядок предоставления государственных услуг по подтверждению наступления форс-мажорные обстоятельства по внешнеторговым сделкам, международным, финансовым и инвестиционным договорам.
Сертификат о форс-мажоре будет подтвержден электронной подписью и выдан в течение 13 рабочих дней. Уполномоченным органом определено Министерство инвестиций и внешней торговли.
Постановление вступает в силу 30 декабря 2022 года.
Business control procedure comes into force
In accordance with the Presidential Resolution, starting from November 1, 2022 all inspections must be registered in the electronic system “Single State Control”. Conducting an unregistered inspection is considered illegal.
Вступает в силу порядок проверки бизнеса
В соответствии с Постановлением Президента, с 1 ноября 2022 г. все проверки должны быть зарегистрированы в электронной системе “Единый государственный контроль”. Проведение незарегистрированной проверки считается незаконным.
