Unified National Valuation Standards were approved

The State Assets Management Agency has approved the Unified National Valuation Standards (the “Standards”). These Standards delineate the regulatory framework governing valuation activities and set forth requirements for the procedures involved in conducting valuations and expert assessments.

A comprehensive set of 14 Standards has been endorsed. These encompass both general and specialized appraisal standards, along with their corresponding methodologies. They establish the essential methods required to determine the value of specific objects under assessment.

It is imperative to note that adherence to these Standards is obligatory when rendering services for the valuation of assets and liabilities, preparing a valuation report, and when experts are verifying the reliability of the valuation report pertaining to the assessed object.

Утверждены Eдиные национальные стандарты оценки

Агентство по управлению государственными активами утвердило Единые национальные стандарты оценки («Стандарты»), которые определяют нормативное регулирование оценочной деятельности и устанавливают требования к порядку проведения оценки и экспертизы оценки.

Всего утверждено 14 Стандартов, включающие в себя общие и специальные стандарты оценки и методики к ним, устанавливающие минимальные методы, необходимые для оценки стоимости конкретных объектов оценки

Данные Стандарты обязательны к применению при оказании услуг оценки стоимости активов и обязательств, составлении отчета об оценке, а также при проверке экспертами достоверности отчета об оценке объекта оценки.

The protection of consumer rights and the fight against crime in the digital sphere have been strengthened

In pursuit of advancing the digital economy and fortifying the protection of consumers’ rights in the realm of digital products and services while addressing digital crimes, a Presidential Resolution has been enacted. Effective July 1, 2024, the following stipulations have been established:

• payment system operators and payment organizations are established and operate exclusively in the form of a joint-stock company, 
• the minimum charter capital for payment system operators is set at UZS 50 bln (approximately USD 4 mln). For payment organizations - at minimum of UZS 10 bln (approximately USD 810 000), with a subsequent increase to UZS 20 bln (approximately USD 620 000) from July 1, 2025.

Additionally, the Central Bank is now empowered to issue mandatory directives to commercial banks, payment system operators, and payment organizations, allowing the temporary restriction of the utilization of bank cards, bank accounts, and accounts on mobile applications for up to 3 days in cases involving questionable (fraudulent) transactions related to bank cards. 

Усилена защита прав потребителей и борьба с правонарушениями в цифровой сфере 

В целях дальнейшего развития цифровой экономики, усиления защиты прав потребителей цифровой продукции (услуг) и борьбы с правонарушениями, принято Постановление Президента, согласно которому, с 1 июля 2024 г. устанавливаются следующие требования:

• операторы платежных систем и платежные организации  учреждаются и осуществляют свою деятельность  только в форме акционерного общества;
• минимальный уставный капитал операторов платежных систем составит 50 млрд сумов (приблизительно 4 млн долларов США ). Для платежных организаций -  не менее 10 млрд сумов (приблизительно 810 000 долларов США), с дальнейшем увеличением до 20 млрд сумов (приблизительно 620 000 долларов США) с 1 июля 2025 г.

Также, теперь Центральный банк уполномочен направлять обязательные указания коммерческим банкам, операторам платежных систем и платежным организациям о временном ограничении использования на срок до 3 дней банковских карт, банковских счетов и счетов на мобильных приложениях в случае осуществления сомнительных (фрод) операций, связанных с банковскими картами.

The regulation of lease relations in the use of land plots of the state forest fund has been improved

Commencing January 1, 2024, the process of collecting, reviewing, and coordinating materials related to the leasing of unused land plots from the forest fund will be conducted exclusively through the information system “E-ijara”.

A “zero rate” of rental fee is envisioned for desert and waterless lands of the forest fund.

Until July 1, 2024, all existing lease agreements for lands within the forest fund must be officially registered with the authorities of the Cadastral Agency. Failure to register these contracts will result in their termination, and the land plot will be subjected to online auction.

The allocation of land plots to entities with foreign investments, international associations and organizations, as well as foreign individuals and legal entities, will be overseen by the Cabinet of Ministers.

Усовершенствовано регулирование арендных отношений при пользовании земельными участками государственного лесного фонда. 

С 1 января 2024 года сбор, рассмотрение и согласование с государственными органами материалов по предоставлению неиспользуемых земельных участков лесного фонда в аренду будет осуществляться посредством информационной системы «E-ijara»; 

Для пустынных и необеспеченных водой земель лесного фонда предусмотрена «нулевая ставка» арендной платы.

До 1 июля 2024 года все действующие договоры аренды земель лесного фонда подлежат в органах Агентства по кадастру.

Незарегистрированные договоры будут прекращены, а земельный участок выставлен на онлайн-аукцион.

Предоставление земельных участков предприятиям с иностранными инвестициями, международным объединениям и организациям, иностранным физическим и юридическим лицам будет осуществляться Кабинетом Министров.

The Rules for registration of the appellation of origin of goods and granting the right to use the name of places of origin of goods were approved.

The Ministry of Justice has approved the Rules for the compilation, submission, and consideration of applications for the registration of the designation of the origin of goods and the provision of the right to use the designation of the origin of goods (the “Rules”). The Rules encompass the following provisions:

• The procedure for submitting an application for the registration of a trademark, the designation of the origin of goods, and the right to use the designation of the origin of goods,
• Requirements for the application for registration and its contents,
• The process for the review and examination of the application, among other aspects.

These Rules are designed to regulate and standardize the process of applying for and registering the designation of the origin of goods, ensuring compliance with the established legal framework.

Утверждены Правила на регистрацию наименования места происхождения товара и предоставления права пользования наименованием места происхождения товара.

Министерство юстиции утвердило Правила составления, подачи и рассмотрения заявки на регистрацию наименования места происхождения товара и предоставления права пользования наименованием места происхождения товара («Правила»). Правилами утверждены следующие положения:

• порядок подачи заявки на регистрацию товарного знака, наименования места происхождения товара и права пользования наименованием места происхождения товара;
• требования к заявке на регистрацию и ее содержание;
• порядок рассмотрения и экспертизы заявки и др.

Данные Правила предназначены для регулирования процесса подачи и регистрации наименования места происхождения товара и обеспечения соответствия установленным законодательным требованиям.  

The Draft Law «On real estate activity» has been drafted

The State Assets Management Agency (“SAMA”) has introduced a draft law on real estate activities (“Draft Law”) for public discussion.

According to the Draft Law, it proposes legislatively adopting fundamental concepts such as real estate services, a realtor's qualification exam, real estate organization, real estate agent, and others. It also suggests establishing a Unified Registry of Realtors, Real Estate Organizations, Real Estate Agents, and Professional Public Associations.

SAMA has been designated as the authorized body in the real estate market. The plan includes the implementation of a Code of Professional Conduct for realtors, which will set requirements for the operation of real estate companies and the documentation they produce.

The discussion of the Draft law concluded on December 29, 2023.

Разработан проект новой редакции закона «О риэлторской деятельности».

Агентство по управлению государственными активами («АУГА») выставила на общественное обсуждение законопроект о риэлторской деятельности («Законопроект»).  

Согласно Законопроекту, предлагается законодательно принять такие основные понятия как риэлторские услуги, квалификационный экзамен риэлтора, риэлторская организация, агент по недвижимости и другие, а также создать Единый реестр риэлторов, риэлторских организаций, агентов по недвижимости и профессиональных общественных объединений. 

Уполномоченным органом в сфере риэлторского рынка назначено  АУГА

Планируется  введение Кодекса профессионального поведения риэлторов, которые установят требования к работе риэлторских компаний и оформляемой документации. 

Обсуждение законопроекта завершено 29 декабря 2023 года.
