La pena va dai 14 ai 20 anni di reclusione. La legge non include relazioni zio/nipote, cugino/cugina. Si rivolge inoltre a rapporti eterosessuali e sembra quindi che tra membri dello stesso sesso non sia reato.
Il codice Indiano non contiene alcuna disposizione specifica contro l’incesto ma soltanto per l’abuso di minori da parte del genitore.
In Malaysia è incesto il rapporto sessuale tra persone le quali, secondo la legge, la religione e/o la consuetudine non viene consentito loro di sposarsi a causa della relazione biologica o meno, intercorrente. Oltre alla fustigazione, la pena è dai 6 ai 20 anni di carcere. Se all’incesto è associato lo stupro, la condanna può salire fino a 30 anni. Il diritto malese considera incesto anche il rapporto sessuale con membri della famiglia acquisita.
Il codice di famiglia Filippino specifica che i matrimoni tra consanguinei vanno considerati nulli sin dal principio.
In Turchia l’incesto tra adulti consenzienti è perfettamente legale. E’ vietato il matrimonio tra genitore e figlio adottivo o tra fratelli, mentre tra cugini è consentito.
In Vietnam l’incesto tra persone con legami di sangue diretti è illegale e può portare fino a 5 anni di carcerazione.
In Austria l’incesto è vietato ed è punibile fino a due anni di prigione, come in Danimarca, da 2 a 6 anni di reclusione.
In Finlandia l’incesto è punibile con una multa e fino a 2 anni ci carcere, mentre non è punibile l’eventuale minorenne coinvolto.
Il codice napoleonico del 1810 ha abolito tutte le disposizioni contro l’incesto in tutto il territorio Belga e Francese. Nel 2010 la Francia ha ripristinato una legislazione riguardo l’incesto, definendo però esclusivamente come stupro o abuso sessuale su minori compiuto da un parente. L’incesto tra adulti consenzienti non è proibito.
In Germania invece è considerato incesto solo il rapporto vaginale (eterosessuale) tra consanguinei, punibile con un ammenda e 3 anni di prigione. Non è punibile l’incesto tra minori ma l’incitamento a quest’ultimo si. Proibito il matrimonio tra parenti ma, in una sentenza del 2008 l’incesto tra adulti è stato contestato in un caso avvenuto.
In Irlanda esiste una legge contro l’incesto fin dal 1908, ma questa fa riferimento solo alle relazioni di tipo vaginale, non includendo quindi quelle omosessuali. La pena massima può arrivare fino a 7 anni per la donna e l’ergastolo per l’uomo.
In Italia è illegale ma è punibile solo se da esso deriva pubblico scandalo (a discrezione del giudice)
Nei Paesi Bassi l’incesto tra adulti consenzienti è perfettamente legale.
In Polonia l’incesto è punibile fino a 5 anni di carcere.
In Portogallo non è espressamente vietato l’incesto.
In Romania viene considerato reato anche tra adulti consenzienti ed è punibile con 5 anni di reclusione.
In Russia invece l’incesto tra adulti consenzienti non è un crimine ma il matrimonio tra parenti è vietato.
In Spagna l’incesto tra adulti consenzienti è perfettamente legale.
In Svizzera l’articolo 213 del codice penale vieta l’incesto, nel 2010 il governo federale ha proposto di abolire questo divieto.
Nel Regno Unito L’incesto è illegale ed è punibile fino a 2 anni di carcere.
Secondo la legge Canadese commette incesto chi ha rapporti sessuali con un parente conoscendo l’esistenza del rapporto di consanguineità ed è passibile di condanna da 5 a 14 anni di reclusione.
In Argentina l’incesto è legale se entrambe le persone sono sopra l’età minima del consenso sessuale.
Per finire In Nuova Zelanda l’incesto è vietato e punibile dalla legge.
Notizia del 2015, In Germania il consiglio di bioetica fa discutere il paese per la “riabilitazione” di rapporti incestuosi. Il consiglio ha affrontato un caso di una coppia di fratello e sorella con 4 figli esprimendosi dunque sul tema della legalizzazione dell’incesto. Malgrado l’alta probabilità di malformazioni per i bimbi nati da coppie di fratelli, per il comitato questo pericolo non vale la criminalizzazione dell’incesto. In Germania la legislazione prevede 2 anni di reclusione per i casi di incesto, il comitato ha votato a favore della legislazione con 14 a favore e 9 contro.
Sempre nel 2015 in Oregon padre e figlia hanno scioccato l’opinione pubblica con la loro relazione piena d’amore. Da questa relazione sono nati 2 figli con alcuni problemi genetici che sono stati loro sottratti dai servizi sociali. Lo stato americano li ha condannati per incesto.

A confermare le accuse il test del DNA secondo il quale la bimba è frutto dell’incesto.
In Florida poi un 68enne sposa una 24enne e dopo 3 mesi di matrimonio ha scoperto di esserne il nonno. Si conoscono tramite portale di un agenzia matrimoniale e si sposano. Non sono i 44 anni di differenza tra i coniugi la particolarità, guardando vecchi album di famiglia i 2 avrebbero scoperto di avere parentela stretta. Pare comunque che i due non abbiano intenzione di divorziare.
Cosa dire dopo questo articolo di informazione globale e qualche storia di cronaca, nel 2020 si rimane ancora attoniti di fronte a questo fenomeno tanto diffuso, sarà l’impronta della società oppure il moralismo ma, Miss P pensa che andare contro natura in questo caso non sia giusto e quindi invita a riflettere ed a denunciare qualora ci siano i presupposti!!
