A South Carolina Senate committee has removed exceptions for rape and incest from a bill banning nearly all abortions
COLUMBIA, S.C. -- A South Carolina Senate committee voted Tuesday to remove exceptions for rape and incest from a proposed abortion ban setting up a showdown among Republicans wary of passing such a restrictive bill.
Democrats helped set up the fight, choosing not to vote with three moderate Republicans who wanted to keep the exceptions in the bill.
The same bill without the exceptions appeared to fail in the more conservative state House last week before some Republicans maneuvered through a series of votes to allow abortions for rape and incest victims up to the 12th week of pregnancy.
The Senate Medical Affairs Committee vote 9-8 with two Republicans joining all Democrats — to send the bill to the full Senate, where debate is expected to begin Wednesday morning. The exceptions could be restored during that debate.
Democrats also refused to vote on other proposals by Republican Sen. Tom Davis, who has said for weeks the bill needs to be modified from a total ban before he can support it.
They included increasing access to contraceptives and including birth control as part of the state's abstinence-based sex education as well as assuring that a doctor can perform the abortion if it is determined a fetus has a medical condition that won't allow it to live outside the womb.
Democrats are not going to help Republicans out of a box of their own making by making “an awful bill a very bad bill,” Senate Minority Leader Brad Hutto said.
“We think by highlighting the fact a bunch of extreme, Republican men are trying to control women’s decisions in South Carolina — they need to own that. The governor needs to own that,” Hutto told reporters.
Republicans told their Democratic colleagues their strategy was shortsighted.
"We heard a lot of talk about protecting women's rights. It looks like when they had a chance, they didn't," Republican Sen. Michael Gambrel said.
Several Republicans senators have said they cannot support the bill without the exceptions for pregnancies caused by rape and incest. There are 30 Republicans and 16 Democrats in the state Senate.
Senators will get another chance to change the bill Wednesday, including adding the exceptions back or any amendments that were rejected at Tuesday's meeting.
The bill bans all abortions in South Carolina except when the mother’s life is at risk. Before they were removed, the bill also included exceptions for pregnancies caused by rape and incest. In those cases, the doctor would have to tell the woman the rape will be reported and her name given to the county sheriff within 24 hours of the procedure. The bill would have only allowed abortions in those cases up to 12 weeks after conception.
The proposal also starts child support payments at the date of conception and requires a father to pay half of pregnancy expenses, including the mother's share of insurance premiums. The father of a child conceived by rape or incest must also pay the full cost of mental counseling from the attack.
South Carolina currently has a ban on abortions once cardiac activity in a fetus is detected, which is usually about six weeks. But that law has been suspended as the South Carolina Supreme Court reviews whether it violates the state’s constitutional right to privacy. That leaves South Carolina’s older 20-week abortion ban as the current benchmark.
Abortion bans have had mixed success in state legislatures since Roe v. Wade was overturned. Indiana passed a ban in August that goes into effect later this month with the rape, incest and life of the mother exceptions. West Virginia’s Legislature could not agree on stricter rules during a special session in July.
And lawmakers in South Carolina suddenly started paying much closer attention to Kansas when nearly 60% of voters rejected a ballot measure that would have allowed the state’s Legislature to ban abortion. The states voted for Republican Donald Trump in nearly identical percentages in the 2020 presidential election.
Davis and Sen. Sandy Senn, who voted against the bill in committee, have said they can't support it as written. Another Republican senator, Katrina Shealy, said the state's current law is fine. Other senators have suggested privately that the General Assembly didn't need to rush into a special session and could have waited to see how the six-week South Carolina ban and total bans in other states worked out.
Davis told the committee he thinks the rights of a mother who is pregnant to control her own body have to be balanced with the rights of fetuses to their lives, so he considers both a ban on all abortions or allowing abortions any time during pregnancies too extreme.
Davis also said if the state is going to require more women to have babies, then they owe it to them to give them better prenatal care, their children better educational opportunities and birth control options so they don’t get pregnant.

The South Carolina Senate’s debate Wednesday on an abortion ban that no longer includes exceptions for pregnancies’ caused by rape and incest is likely to leave Republicans facing off with each other
COLUMBIA, S.C. -- South Carolina's looming Senate debate Wednesday on an abortion ban that would no longer include exceptions for pregnancies caused by rape and incest is likely to leave Republicans facing off with each other.
On the one side are a core group that views any abortion as ending a life. On the other are conservatives who've digested developments elsewhere after Roe v. Wade was overturned and say they don't want 14-year-old rape victims to have to give birth or force a mother to carry to term a fetus unable to live outside the womb.
Debate on the Senate floor is set to start Wednesday morning. Senators have been told the proceedings could last days, although they have recently tried to conclude such debates in marathon one-day sessions.
Democrats on the Senate Medical Affairs Committee helped set up the showdown Tuesday, refusing to vote as the more conservative Republicans removed the exceptions for rape and incest from a bill that passed the House last week. And if the Senate approves the ban, it would return to the House.
Democrats are not going to help Republicans out of a box of their own making by making “an awful bill a very bad bill,” Senate Minority Leader Brad Hutto said.
The same bill without the exceptions appeared to fail in the more conservative state House last week before some Republicans maneuvered through a series of votes to allow abortions for rape and incest victims up to the 12th week of pregnancy.
The final vote in Tuesday's committee meeting could foreshadow the closeness of any vote in the full Senate. The Medical Affairs Committee vote 9-8 with two Republicans joining all Democrats.
Democrats also refused to vote on other proposals by Republican Sen. Tom Davis, who has said for weeks that the bill needs to be modified from a total ban before he can support it.
They included assuring that a doctor can perform the abortion if it is determined a fetus has a medical condition that won’t allow it to live as well as increasing access to contraceptives and including birth control as part of the state’s abstinence-based sex education.
Those ideas could be taken up on the Senate floor along with a reconsideration of the rape and incest exceptions.
In a likely preview of the fight on the Senate floor, Davis clashed in the committee meeting with fellow Republican Sen. Richard Cash, whose main focus during his five years in the Senate has been on ending all abortions.
“If you are over the age of 13, we kind of expect you to have sex. We’re going to provide you with all the contraceptives' you are going to need," Cash said of Davis' proposal to make birth control available with parental consent. “It borders on encouraging immorality.”
Davis has said for weeks that if the state is going to ban nearly all abortions it needs to make sure that mothers receive adequate prenatal care and the additional babies born get education and child care help.
”You have a different view of the role of the state in society," Davis responded to Cash. “I don’t look to the state to dictate what my morals are.”
There are 30 Republicans and 16 Democrats in the state Senate.

A controversial vlogger has been arrested in Virginia for incest — after audio was leaked online of her allegedly confessing to regular sex with her dementia-ridden mom, according to reports.
Comic character creator Christine Weston Chandler, known online as Chris Chan, was busted in Richmond on Sunday and later transferred to Central Virginia Regional Jail, where she is being held without bail, officials confirmed to The Post.
Greene County Sheriff’s Office confirmed in a Facebook post that Chandler was charged with one count of incest, calling Chandler “he” despite the trans vlogger’s preferred pronouns.
Her arrest came a day after the sheriff’s office “received information involving sex crimes against a family member,” the sheriff’s office said, confirming Chandler and the alleged victim both live in the county.
“This is an ongoing investigation with additional charges pending,” the sheriff’s office said.
The 39 year old — who is also known online as Sonichu — already faces up to 12 years in prison if convicted of the single count of incest, ABC7 noted .
The arrest came after a taped phone call was leaked allegedly catching Chandler confessing to having sex with her 79-year-old mother, whom she repeatedly featured in her online postings and has revealed suffers from dementia, according to Insider as well as local ABC station.
Calling it “incest fan” fiction come true, the person on the tape who is alleged to be Chandler said that her mom “made the first move,” admitting she was “partially confused” and “it took a few tries” to get right, the reports said.
They would go on to have sex “every third night” — but had an “open relationship,” the voice purported to be Chandler told an unidentified woman in the clip.
The audio suggested Chandler — who ABC7 said is autistic — admitted it happened when she was “very, very horny” — and that “God … said it was OK.”
Chandler appeared to be aware of her impending arrest in her last Twitter post on Friday.
“Today’s Collective Card, appropriately, is Turning In,” she wrote , featuring an image from Collective, a community-created card game.
“There is drama in the air today. Each and every one of you all are encouraged to withdraw from any and all dramas, gossip, rumors, and whatever else will, and already has, approached your way today,” she wrote.
Her arrest had been filmed by blogger Ethan Ralph , showing her led away from a Regency Inn in handcuffs as someone shouted at her, “Go to church!”
“I am compliant, I am good like this, Chandler called out to those filming her being detained by three officers.
“I am Chris Chan Sonichu, your Goddess Blue Heart and I continue to stand strong and I maintain everything with CWCville and my Sonichu, Rosechu and everybody,” she shouted of her cartoon creations.
“I keep in good faith — everything is going to work out,” she shouted — even joking that it “felt good” when one of the officers frisked her around her chest.
Chandler has featured her mother on her social media pages several times over the years, most recently on July 11, when she shared photos of her sporting a new haircut.
“Barbie Chan got a styling haircut. I did that; first time cutting anyone’s hair. It looks really good,” she wrote.
In May, Chandler shared a series of photos of her mother as a younger woman as part of a tribue.
“Hi, Mom. Remember, everyone, regardless of situation, your Mom, Mother, or Motherly Figure had a life and past of her own back in the day before you came along. She has gone through a lot for not only you and yours, but herself as well,'” Chandler wrote.
The pair were previously arrested 10 years ago after Barbara hit a local game store manager with her car, leading them to pay a fine and undergo community service and a year of probation, The Sun said .
Chandler was also given a suspended jail sentence for Macing a GameStop worker in 2014, the outlet said.
