iWish Terms of Service

Welcome to iWish.me (“iWish,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our website, mobile applications, and related services (collectively, the “Service”).

By creating an account, using the Service, or clicking “I Agree,” you agree to these Terms.


1. Overview of the Service

iWish provides an online platform that enables creators, individuals, and organizations (“Creators”) to publish wishlists and receive monetary contributions (“Gifts”) from supporters (“Gifters”). iWish facilitates the listing, promotion, and processing of these Gifts through integrated payment providers.

iWish itself does not sell or deliver any goods or services on behalf of Creators.


2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract to use the Service. If you use iWish on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.


3. Accounts

  • You are responsible for maintaining the confidentiality of your login credentials.
  • You must provide accurate and complete information and update it as necessary.
  • iWish may suspend or terminate accounts that violate these Terms or our policies.

4. Gifts, Fees & Payments

  1. Transaction Structure
  2. Gifters make monetary contributions to fulfill a Creator’s wish.
  3. Payments are processed by our third-party payment processor (the “Payment Processor”), currently [insert processor name, e.g., Paystack/Stripe/Flutterwave].
  4. iWish Service Fee
  5. iWish charges a platform service fee 5% - 10% of each Gift (“Service Fee”).
  6. This fee is deducted automatically before funds are disbursed to the Creator.
  7. Payment Processor Fees
  8. The Payment Processor charges its own processing fee (for example, a percentage plus a fixed amount per transaction).
  9. These fees are in addition to iWish’s Service Fee and are also deducted automatically.
  10. Payouts
  11. After deduction of iWish’s Service Fee and the Payment Processor’s fees, the net amount is remitted to the Creator’s designated payout account.
  12. Timing of payouts may vary depending on banking networks, the Payment Processor, and verification requirements.
  13. Taxes
  14. Creators are solely responsible for reporting and paying any taxes due on funds received. iWish does not provide tax advice.

5. Creator Use of Funds

  • Independent Control: iWish provides only the platform and payment infrastructure. We have no control over, and accept no responsibility for, how any Creator uses or manages the funds received through the Service.
  • No Oversight Obligation: iWish is not required to monitor, audit, or verify that a Creator spends contributions in any particular way.
  • Gifters’ Acknowledgement: By sending a Gift, you acknowledge that your contribution is voluntary and that iWish is not liable if the Creator uses the funds for purposes other than those stated in their wishlist or profile.
  • Disputes: Any dispute regarding the use of funds is strictly between the Gifter and the Creator.

6. Acceptable Use

You agree not to use iWish to:

  • Violate any law, regulation, or third-party rights.
  • Fund illegal activities, money laundering, or fraudulent schemes.
  • Post obscene, hateful, or infringing content.
  • Circumvent our fee structure or payment flow.

iWish may remove content, suspend, or terminate accounts that breach these rules.


7. Intellectual Property

All iWish trademarks, logos, software, and content (excluding user-generated content) remain the property of iWish or its licensors. You may not copy, modify, or distribute our proprietary materials without consent.


8. User Content

By posting wishes, images, text, or other materials (“User Content”), you grant iWish a worldwide, non-exclusive, royalty-free license to use, display, and distribute that content solely to operate and promote the Service.


9. Disclaimers

  • The Service is provided “as is” and “as available” without warranties of any kind.
  • iWish makes no representations or warranties about:
  • The intentions, conduct, or actions of any Creator or Gifter.
  • How Creators spend or manage the funds they receive.
  • Any goods or services that Creators may later purchase or provide.
  • We do not guarantee that Gifts will be fulfilled or that funds will be spent for any specific purpose.

10. Limitation of Liability

To the maximum extent permitted by law, iWish is not liable for:

  • Indirect, incidental, or consequential damages.
  • Loss of profits, revenue, data, or goodwill.
  • Any disputes or claims related to a Creator’s use of funds.
  • Any issues arising from third-party payment processors.

Our total liability to you for any claim will not exceed the total fees you paid to iWish in the past six months.


11. Indemnification

You agree to defend, indemnify, and hold harmless iWish and its affiliates from claims, damages, or expenses arising from:

  • Your use of the Service,
  • Your breach of these Terms, or
  • Your violation of any law or third-party rights.

12. Termination

We may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or pose a risk to iWish or other users.


13. Governing Law & Dispute Resolution

These Terms are governed by the laws of [insert governing jurisdiction, e.g., the Federal Republic of Nigeria].

Any dispute shall be resolved by [arbitration/mediation/court venue] located in lagos, Nigeria, unless otherwise required by law.


14. Changes to These Terms
