Government Surveillance and Personal Freedom

What the domestic surveillance apparatus does and what the libertarian response is

The Apparatus

The domestic government surveillance apparatus -- the NSA's bulk data collection, the FBI's domestic intelligence operations, the specific fusion centres that aggregate state and local surveillance, and the specific digital surveillance authorities that the Patriot Act and its successors have produced -- is the specific surveillance infrastructure that the libertarian tradition identifies as the primary domestic threat to individual freedom.

The Libertarian Response

The libertarian response: the Electronic Frontier Foundation, the Cato Institute, the ACLU, and the specific legal challenges that the surveillance apparatus has produced represent the organised libertarian response to government surveillance. The response has produced specific legal victories -- the Section 215 bulk phone record collection was found unlawful and reformed -- and has not fundamentally changed the surveillance architecture that the post-9/11 legislation produced.
