A gallery was today told it could continue to display controversial photographs of naked children without fear of police prosecution despite claims the exhibition is obscene.
The Crown Prosecution Service announced that it would not bring criminal proceedings against the gallery or the artists concerned.
Police were called to the Saatchi Gallery in north London last week after complaints that the pictures, taken by two photographers, were indecent and would appeal to paedophiles.
But a CPS spokesman said that after careful consideration there was no realistic prospect of any conviction under the Protection of Children Act 1978.
The spokesman said: "The CPS has advised the Metropolitan Police that proceedings should not be brought against the Saatchi Gallery over photographs exhibited in the gallery.
"In reaching this decision, the CPS considered whether the photographs in question were indecent and the likely defence of the gallery, ie whether they had a legitimate reason for showing them."
The pictures show the youngsters in various naked poses and wearing masks.
The majority were taken by Ms Gearon of her own children.
A spokesman for the gallery said that the two artists and staff at the gallery were delighted with the CPS decision.
"Everyone at the Saatchi Gallery is very relieved as are all the artists in the show," the spokesman said.
"It's been a very worrying time for the two artists involved and their families. We are extremely grateful to the public and press who have supported the artists and the gallery."
The photographs will remain on show until the end of the exhibition on April 15.
A Scotland Yard spokesman said it remained the police's responsibility to act on complaints from the public, particularly in relation to children.
"We will continue to strongly police the law concerning the protection of children and where we see a risk we will take action," the spokesman said.

Country House offers naturists a way to air all.
News reporters Tony and Sally Adams visit a nudist centre at a country hotel in South Devon. The beach at Slapton Sands Nature Reserve and nearby Pilchard Cove have been frequented by nudist bathers for decades. Naturists advocate acceptance of social nudity and enjoy embracing the great outdoors through walking in the woods, relaxing on the beach, swimming in the pool and nude sea bathing. Locals turn a blindish eye and maintain that there is nothing wrong with nudism.
In 1970 International Naturist Federation held its annual congress in Britain. The first annual naturist world congress was held in London in 1951 although the International Naturist Federation (INF) was officially founded in 1953 in Montalivet in France. British Naturism can trace its origins back to 1891 and the Fellowship for the Naked Trust in British India. In 1922 the English Gymnosophical Society was formed based on the work into naturism of Harold Booth. The British Sun Bathers Association (BSBA) of 1943 and the Federation of British Sun Clubs (FBSC) of 1953 merged to form the Central Council for British Naturism (CCBN) in 1964 which officially became British Naturism in 2009.

A student is counting the cost of cheap drinks promotions today after video of her dancing naked in an inflatable paddling pool at a nightclub went viral on the internet.
The university student - who MailOnline has chosen not to identify - woke up this morning to find that a 10-minute video of the incident at Oceana nightclub in Cardiff had been circulated widely on Twitter.

Her behaviour is a classic example of Britain's binge-drinking culture - and the embarrassment it can cause.
And the speed with which her drunken antics went viral highlights the power of social media.
A one-minute version was available on YouTube and attracted more than 1,000 hits in less than 10 minutes. It has now been removed.
The 20-year-old took part in a wet T-shirt contest as part of the Missbehaviour event - billed as 'Cardiff's naughtiest night' - where vodka and other spirits cost just £1.75 for a double.
At the event, which boasts the cheapest drinks in Cardiff, bottles of lager and alcopops were on sale at £1.20. 
While other girls thought it enough to remove their tops, the student stripped off entirely and frolicked in the inflatable paddling pool.
With another reveller filming the 'contest' on a mobile phone, she leans over the edge of the pool plays for the cameras.
The Rihanna song S&M plays loudly in the background as men cheer and chant 'Off, off, off.'
As the student is exposing herself herself, the MC uses his microphone to shout: 'Get em 'off'.
The shame-faced student, who had clearly been drinking, used her Twitter account to send a message a day later which read: 'Yes I got drunk and yes I got naked.
'We all do things we regret and there is nothing I can do about it now!'
The embarrassed student later Tweeted that she had also lost her underwear, her earrings and had not been given
