The development of European private law by means of legislative instruments and regulatory mechanisms of the European Union generally occurs on the basis of decisions serving the short-term requirements of political agendas. There has been no overarching concept and this has resulted in a body of rules that is not easy to penetrate.

Cheaper flights, lower roaming charges, access to an ever wider range of products. All of these are cited as advances attributable to the European Internal Market. But has the insurance market witnessed similar improvements?

The Institute aims to offer critical input on developments in European private law from a scholarly perspective. It is committed to providing scholarly guidance through the maze of discourses and regulations, analysing and systematising the puzzle pieces of the piecemeal regulations of European private law, and developing new proposals for solutions.
The body of private law rules set out in EU legislation has grown significantly over the last decades and it continues to expand in scope. On account of the fragmentary structure of EU law, it is usually only specific areas that are the object of legal study, such as EU labour law, EU company law or EU consumer law.
Mit den 2018 erschienenen „Commentaries on European Contract Laws“ haben es sich Institutsdirektor Reinhard Zimmermann und Nils Jansen als Herausgeber gemeinsam mit zwanzig weiteren Wissenschaftlerinnen und Wissenschaftlern zur Aufgabe gemacht, die Entwicklung eines einheitlichen europäischen Privatrechts zu bilanzieren und Orientierung für die Zukunft zu bieten. Eine von den Ediciones Olejnik neu ins Leben gerufene Publikationsreihe zum europäischen Privatrecht hat nun als ihren ersten Band das von Reinhard Zimmermann verfasste Kapitel über den vertraglichen Schadensersatz in spanischer Übersetzung publiziert.
Prof. Dr. Jürgen Basedow, emeritierter Direktor des Max-Planck-Instituts für ausländisches und internationales Privatrecht, unterzieht in seinem Beitrag „EU Private Law in Ukraine – The Impact of the Association Agreement“ die Vereinbarungen zur Marktintegration zwischen der EU und der Ukraine einer kritischen Analyse.

On Europe Day, held annually on 9 May, the European Union celebrates peace and unity in Europe. As its basic foundation, this harmony rests on a close cooperation practised between nations. In the area of private law, however, the law of the individual Member States is not unified.

For the transnational lawyer the present European situation is equivalent to that of a traveller compelled to cross legal Europe using a number of different local maps. To assist lawyers in the journey beyond their own locality The Common Core of European Private Law Project was launched in 1993 at the University of Trento under the auspices of the late Professor Rudolf B. Schlesinger. The aim of this collective scholarly enterprise is to unearth what is already common to the legal systems of European Union member states. Case studies widely circulated and discussed between lawyers of different traditions are employed to draw at least the main lines of a reliable map of the law of Europe.
