Accused 1 would provide accommodation, food and clothing. Accused 3 contacted accused 1 telephonically in her presence and made arrangements to meet at a lodge. Accused stated he was specifically looking for a white female and asked CF and another girl M if they smoked rock. She thought about leaving the flat but did not know where she was. The accused again gave her 4 pieces of rock to smoke and she went to stand outside for purposes of prostitution. She was sent out onto the street by the accused to sell herself for prostitution. She was scared and did what she was told as she did not know where she was. She and other girls were arrested by the police. She called her aunt and accused 1. The accused picked her up and again told her to smoke 4 pieces of drugs. She smoked 2 pieces and swallowed 2 pieces — she felt very sick. She told the accused she was going outside to stand. She called her aunt and uncle and they fetched her from the street and reported the matter to a police station. The drugs had a severe effect on her health and she was later hospitalised. In aggravation of sentence the state told the court that trafficking in persons is regarded as the fastest growing criminal activity in the world and it generates billions of dollars in earnings for traffickers. The State asserted that the accused have been convicted of severe offences and asked that the court deliver a sentence that will have a deterrent effect on would be offenders. Accused 1 was convicted of eight counts, namely: two counts of trafficking in persons, two counts of kidnapping, one count of sexual assault, one count of rape, one count of assault GBH and one count of keeping a brothel. He was sentenced to an effective 30 years imprisonment. Accused 2 was convicted of two counts of trafficking in persons and sentenced to 5 years imprisonment for each count. The presiding officer ordered that the sentences run concurrently, resulting in an effective sentenced to 5 years imprisonment. Accused 3 was convicted of one count of kidnapping and was sentenced to 2 years imprisonment, wholly suspended for 5 years on condition that he is not convicted of kidnapping or attempted kidnapping during this time.
