The Notary-tech arrives 30 minute in advance to setup the equipment and hand out Real Time Testimony Taggers (RTTT) to those that wish to use them.

At the conclusion of the Deposition the Notary-tech will load the audio/video and exhibits onto the depose.me online client portal.

Participants may order human (very accurate) transcripts for an additional fee of the entire deposition proceeding, or of specific testimony (excerpts) which can be tagged using the online and desktop review tools provided in depose.me software.

The scheduling party is responsible for the base video deposition fees. Copy fees are rebated, not kept by deposition provider to reduce the scheduling party’s fees.

The law has embraced video and audio recordings because they create a far more reliable record, and tell a more complete picture, than a transcript alone. Despite the skill and training of a court recorder, they are still human and their transcripts are still subject to error. A video tells the entire story though, and takes in red faces, shifty eyes, blushing, anger, fear, hand gestures, confidence in tone, assertiveness, swallowing, etc. Most importantly, video and audio pick up tones that convey a good portion of the expression that is coupled with the words spoken. In short, as a court always wants to have the most reliable evidence, a video is considered superior to that of a transcript alone. If a picture is worth a thousand words, a video would be worth many thousands more.
The use of video/audio recording meets the policy of the Courts as expressed in the Rules of Civil Procedure 1 “to secure the just, speedy, and inexpensive determination of every action and proceeding”.
Until recently the cost to order a video deposition was more expensive than traditional means. This was because of the need to hire both a videographer and stenographer. The turnaround time to get a transcript was often several weeks.
Recent law changes now allow the official record to be the actual video/audio recording so long as it is performed with someone authorized under Rule 28 of the Federal Rules of Civil Procedure. Rule 30 of the Federal Rules of Civil Procedure specifically states that “ any party may arrange to transcribe a deposition “. Since transcription is optional, it is up to each individual whether to order a transcript.
With the online tools available from depose.me there is no compelling reason to order a transcript of the entire deposition even with depose.me low transcription fees. However, it is often times prudent to order selective transcription of key testimony for use when filing pleadings. The legal industry is quickly moving away from transcription in favor of video/audio records due to their inherent 100% accuracy and favorable acceptance by juries.
Video by Notary was pioneered in the late 2000’s by Lee Richan an accomplished engineer and automotive executive. Mr. Richan had spent significant time in corporate litigation and was disgusted by the archaic method of deposition recording that used stenographers. Mr. Richan set out to capitalize on recent State and Federal rule changes aimed at reducing deposition costs by permitting audiovisual technology to be used natively as the official and more accurate record.
Mr. Richan passed away before he could see his dreams come to their full fruition. However the company AVLawDepot , started by Mr. Richan, continues to prosper. AVLawDepot was the first such company in Utah, and arguably the United States, to be formed to perform Video by Notary.
