Online giants like Google, Facebook, Microsoft and messaging platform WhatsApp have all agreed in the Supreme Court that “child pornography, rape and gang rape videos and objectionable material need to be stamped out.”
Appearing before a Bench led by Justice Madan B. Lokur, WhatsApp however submitted that it has an “end-to-end encryption technology due to which it will not be possible to remove the contents.”
The court asked each of these entities to give a proposed/draft SOP for the purpose of implementation of the Centre’s suggestions recorded in its order of November 28.
“Everybody is agreed that the proposed/draft SOP will be drafted on this premise,” the court said in its order while scheduling the next hearing for December 11.
The Centre’s suggestions include setting up of proactive monitoring tools for auto deletion of unlawful content by deploying artificial intelligence-based tools, deployment of trusted flaggers for identifying and deletion of unlawful content, setting up of 24/7 mechanims for requisitions of law enforcement agencies, appointment of India-based contact officers, (with name, designation, email, mobile number), prompt disposal of requisitions of law enforcement agencies to remove unlawful contents.
The court noted that it appeared that each of the different entities has a different reaction to the suggestions.
“Google and YouTube have one reaction. Facebook, Microsoft and WhatsApp have different reactions,” it observed in the order.
The court is hearing petitions highlighting the abuse of online platforms for proliferation and distribution of sexually abusive content.
