Төрийн албаны үндсэн зорилт бол төрийн чиг үүргийг хэрэгжүүлж, биелүүлэх явдал юм. Өөрөөр хэлбэл, төрийн тодорхой байгууллагын хуулиар тогтоосон эрх үүргийг тодорхой албан тушаал эрхлэх замаар хууль тоггоомжийн хүрээнд хэрэгжүүлдэг үйл ажиллагаа гэж хэлж болно.
Монгол улсын төрийн албанд Үндсэн хуулийн нэгдүгээр зүйлийн 2 дахь хэсэгт заасан төрийн үйл ажиллагааны үндсэн зарчим, Төрийн албаны тухай хуулийн дөрөвдүгээр зүйлийн 2 дахь хэсэгт заасан зарчмыг баримтална.
Монгол улсын Үндсэн хуулийн нэгдүгээр зүйлийн 2 дахь хэсэгт заасан ёсоор ардчилсан ёс, шударга ёс, эрх чөлөө, тэгш эрх, үндэсний эв нэгдлийг хангах, хууль дээдлэх нь төрийн албаны үндсэн зарчим юм.
Монгол улсын Төрийн албаны тухай хуулийн дөрөвдүгээр зүйлийн 2 дахь хэсэгт заасан ёсоор төрийн албанд дараахь зарчмыг баримтална. Үүнд:
төрийн албан хаагчийн учруулсан хохирлыг төр хариуцах.
Сонгууль нь улс төрийн албан тушаалтны төрийн албанд орох гол арга бөгөөд энэ нь тодорхой хугацаатай. Ж: УИХ-ын гишүүнийг 4 жилийн хугацаатайгаар бүх ард түмний сонгууль явуулж сонгодог. Мөн сонгоод баталдаг арга гэж байдаг. Ж: Монгол улсын Ерөнхийлөгчийг бүх ард түмний сонгууль явуулж сонгоод, УИХ баталсан тухай хууль гаргадаг.
Томилолтыг дээд шатны байгууллага, албан тушаалтан хийдэг. Нэр дэвшүүлж томилох, зөвшилцөх арга байдаг. Ж: Монгол улсын Ерөнхий сайдыг томилоход УИХ-д олонхийн суудал авсан нам нэр дэвшүүлж Монгол улсын Ерөнхийлөгчтэй зөвшилцөн УИХ-аар батлуулдаг. Монгол улсын Засаг захиргаа, нутаг дэвсгэрийн нэгж, түүний удирдлагын тухай хуулинд зааснаар аймаг, нийслэлийн Засаг даргыг тухайн Иргэдийн төлөөлөгчдийн хурлаас нэр дэвшүүлж Монгол улсын Ерөнхий сайд томилдог.
Томилолтын аргыг хэрэглэхдээ албан тушаалын зэрэг дэв, мэргэжлийн чиг баримжаа, албан тушаалын онцлогоос үндэслэж хэрхэн томилох талаар албан тушаал (ажлын байр)- ны тодорхойлолтод тусгах хэрэгтэй.
Орчин үед төрийн албанд иргэдийг өрсөлдөөнт шалгаруулалтын үндсэн дээр авч ажиллуулах аргыг өргөн хэрэглэж байна. Энэ аргын сонгуулиас ялгаатай нь тусгай журмын дагуу шалгах, өрсөлдүүлэх замаар шалгаруулж ажилд томилдог. Томилолтоос ялгаатай нь хамгийн өндөр оноо авсан нь төрийн албан тушаалд томилогдох боломжтой юм.
Монгол улсын холбогдох хууль тогтоомжид зааснаар төрийн жинхэнэ албаны гүйцэтгэх, туспах тушаалд анх орох иргэдээс өрсөлдүүлэн шалгаруулах зорилго бүхий мэргэжлийн шалгалт авдаг.
Өрсөлдөөнт шалгаруулалтын зарчмын нэг онцлог бол өөрөө нэрдэвшүүлэх боломжийг иргэдэд олгодог. Өөрөөр хэлбэл, төрийн албанд иргэдийг шалгаруулан авах зарын дагуу иргэд өргөдлөө гаргана. Манай улсын хувьд Төрийн албаны тухай хуулинд “материалаа ирүүлнэ” гэж заасан.
Төрийн үйлчилгээний албан тушаалд иргэдийг хөдөлмөрийн гэрээний үндсэн дээр авч ажиллуулдаг. Төрийн үйлчилгээний албан тушаалд ажиллаж байгаа албан хаагчдын хувьд Хөдөлмөрийн хууль, байгууллагын хөдөлмөрийн дотоод журам, хөдөлмөрийн гэрээ нь түүнтэй холбоотой хөдөлмөрийн харилцааг зохицуулах гол эрх зүйн акт, баримт бичгүүд юм.
Төрийн албаны тухай хуулийн 16-р зүйлийн 1 дэх хэсэгт заасан ёсоор “төрийн тухайн албан тушаалд тавих шаардлагыг хангасан иргэний төрийн жинхэнэ албан тушаал эрхлэх эрхийг үндэс, угсаа, арьсны өнгө, хүйс, нийгмийн гарал, байдал, хөрөнгө чинээ, эрхэлсэн ажил, албан тушаал, шашин шүтлэг, үзэл бодол болон нам, олон нийтийн бусад байгууллагын харъяалал зэргээр ялгаварлаж үл болно”.
Төрийн жинхэнэ албан тушаалд дараахь тохиолдолд авч ажиллуулахыг хориглоно [1] 1 . Үүнд:
Төрийн албан тушаалд тавих шаардлага:
Төрийн албан тушаалд тавигдах шаардлагыг хангасан иргэн төрийн албанд орох боломжтой.Төрийн албан тушаалд тавигдах ерөнхий ба тусгай шаардлага гэж байна.
Төрийн албан тушаалд тавигдах ерөнхий шаардлагыг Төрийн албаны тухай хуулийн 10-р зүйлийн 1 дэх хэсэгт заасан байна. Харин тусгай шаардлагыг албан тушаал бүрийн онцлог, ажлын байрны чиг үүргээс шалтгаалан өөр өөрөөр тодорхойлно.
Төрийн албаны удирдах албан тушаалтныг сонгон шалгаруулах
“Төрийн албаны удирдах албан тушаалд сонгон шалгаруулах” гэсэн энэхүү хэсэгт удирдах албан тушаалд дараахь албан тушаалуудыг хамруулан авч үзлээ. Үүнд:
Төрийн албаны удирдах ажилтныг шилж сонгох, томилохдоо дараахь хууль тогтоомж, журмуудыг үндэслэнэ. Үүнд:
Төсвийн байгууллагын удирдлага, санхүүжилтийн тухай хуулийн 45 дугаар зүйлд төсвийн байгууллага, төрийн өмчит болон төрийн өмчийн оролцоотой хуулийн этгээдийн удирдах албан тушаалд нэр дэвшүүлэх журмын талаар заасан байна.
УИХ-ын 2003 оны 13 дугаар тогтоолоор батлагдсан “Төрийн жинхэнэ албаны удирдах албан тушаалд томилогдох ажилтныг сонгон шалгаруулах журам”-д зааснаар дараахь албан тушаал удирдах албан тушаалтны сонгон шалгаруулалтад хамрагдана:
а/ Ерөнхийлөгчийн Тамгын газрын дэд дарга, УИХ- ын Тамгын газрын Ерөнхий нарийн бичгийн дарга, Засгийн газрын Хэрэг эрхлэх газрын тэргүүн дэд дарга, яамны Төрийн нарийн бичгийн дарга, УИХ-д ажлаа тайлагнадаг байгууллагын ажлын албаны дарга болон хуульд өөрөөр заагаагүй бол Засгийн газрын агентлагийн дарга, Улсын ерөнхий прокурорын газрын Тамгын газрын дарга, аймаг, нийслэлийн Засаг даргын Тамгын газрын дарга зэрэг ерөнхий менежерийн үүрэг гүйцэтгэдэг албан тушаалтан;
б/ дор дурьдсан байгууллагын зохион байгуулалтын бүтцийн нэгжийн болон энэ зүйлийн “а”-д зааснаас бусад удирдах албан тушаалтан:
в/ Засгийн газрын тохируулагч агентлагийн зохион байгуулалтын бүтцийн нэгжээс дээшхи, энэ зүйлийн “а”-д зааснаас бусад албан тушаалтан;
г/ Улаанбаатар хотын Ерөнхий менежер, аймаг, нийслэлийн Засаг даргын Тамгын газрын даргаас дээшхи удирдах албан тушаалтан болон ИТХ-ын Тэргүүлэгчдийн нарийн бичгийн дарга
Төсвийн байгууллагын удирдлага, санхүүжилтийн тухай хуулийн 45 дугаар зүйлийн 1 дэх хэсэгт төсвийн байгууллага, төрийн өмчит болон төрийн өмчийн оролцоотой хуулийн этгээдийн удирдах албан тушаалд нэр дэвшүүлэх журмын талаар заасан байна.
Удирдах албан тушаалд томилогдох ажилтныг сонгон шалгаруулахдаа дараахь зарчмыг удирдлага болгоно. Үүнд:
Төрийн жинхэнэ албаны удирдах ажилтан, төсвийн байгууллагын дарга (эрхлэгч), төрийн өмчит болон төрийн өмчийн оролцоотой хуулийн этгээдийн төлөөлөн удирдах зөвлөлийн дарга, гишүүдийг холбогдол хууль, журманд зааснаар шилж сонгох, бүрдүүлэх үйл явцыг хүснэгтээр үзүүлэв.
