The info out there suggests that with a very old conviction you can answer no on ESTA and get in, IF they don't decide to check you on arrival. Good news is if you are successful you don't have to go through all that for subsequent visits. Have a quick search for 'spent convictions act'. You will need to apply for a tourist visa through the US consulate which involves a lot of paper work online , a full police check, and copies of your court records if you have them. You can only get a 12 month visa on your first application so I have to go through the whole process again in the next week or so, but this time I can buy a 3 year tourist visa for about 40 bux. Actually, the drink driving charge wasn't the biggest issue. I'd forgotten until I got my court records that because we'd 'borrowed' a mates car while he wasn't home that I'd also been charged with theft of a motor vehicle, but didn't receive a conviction. It's classed as a crime of moral turpitude crime against humanity. The lovely US consulate officer that filed my application said I shouldn't have any issues which I didn't but it was better to be on the safe side. Just be aware tho that when you go through immigration in the States that you will most likely get ushered up to the immigration office without any explanation as to what is happening for a 'secondary one' interview. This is because you will have an exemption code on the visa and I guess it's some sort of protocol. They then ask you're travel plans, reasons for being in the country, and when you're leaving etcetera, which I had all my printouts for, then they'll stamp you're visa and away you go. So make sure you leave enough time between connecting flights for this interview, which is a first come first serve scenario. One girl before me from a Sydney flight had her visa cancelled on route and they sent her straight back home. Apparently she hadn't declared absolutely everything on her application or she forgot about something and they checked her at random and decided to cancel it on the spot. The immigration officers just go through the process with out blinking. A tax every corner these days. You can test the spent convictions act by applying with the local police for a formal police check not sure what it costs these days. If they come back and say you're clean and they should because your conviction will have been 'spent' , then you're clean. You don't have to declare them in certain circumstances if they are 'spent' under Australian law. Other countries are different and don't regard the convictions as spent, they want to know about them ALL. What about if they ask me if Ive ever been convicted, she said ' say no ' because thats what your history says. Further to that drink driving is not a crime of moral turpitute for the purposes of the USA entry , however for the purposes of Canada entry , drink driving is never spent from your records regardless how long ago and remains on a data base.
