A view of what has happened on the local scene in Malta regarding Marijuana or Cannabis use over recent years is rather confusing and rather unsettling. To state that the laws and restrictions regulating Cannabis use for recreational purposes have not worked is to state the obvious. The biggest problem created by this traditionally restrictive view was the arresting, indictment and even imprisonment of users over the years and their subsequent loss of a clean police record. We have not seen much evidence of major harm or long-term ill effects from its recreational use and clearly many have flouted the law and used it with impunity for many years. Effectively, the vast amounts of illegally smuggled Marijuana on the islands, mostly by ship or smaller boats—estimated by the significant volumes caught locally, suggest that there are strong economic powers involved in its exploitation and exportation. The evidence for the overall harm caused by recreational Cannabis use thus far is not as compelling as it is for tobacco use or alcohol consumption. Indeed, it stands on similar ground to the consumption of red meat in terms of estimated harm and people consume that on a daily basis. The problem with assessing the evidence is that there is often an inherent selection bias in place among those that would experiment with psychoactive substances i. The other problem often raised is the possible shift in use from cannabis to hard drugs the so-called stepping stone hypothesis. Malta had partly liberalized its traditional harsh stand on recreational Cannabis use with a new policy for its decriminalization specifically for the case of persons caught using it recreationally since In , the Maltese Government went for the legalization of medical Cannabis for very few selected medical conditions, 5 in line with what several other countries across Europe were doing at the time. In effect, soon after passing both bills, a large Canadian Company and an Australian Pharma company announced their plans to build Cannabis manufacture and processing facilities in Malta in a move which suggested that these well laid plans existed some time earlier. However, medical marijuana use is far from common today, given the difficult situation faced by patients with the above-mentioned conditions: training Physicians for prescribing and for patient education on Cannabis use, while strongly recommended as essential prior to the introduction of medicinal cannabis, never materialized. Instead, patients continued to find it extremely difficult to obtain prescriptions because of the extensive red tape involved and because of the prohibitive costs of the medicinal products. The state—which provides free-of-charge medicines for a wide range of chronic conditions to local citizens, does not yet supply free medical Cannabis to date. To date in Malta, even with a prescription, medical cannabis is far more expensive and far more inaccessible to obtain than illegal recreational cannabis from the street. There is no evidence of any substantial improvement in pain control emerging from the recent introduction of medical Cannabis. Additionally, anyone requesting prescribed medical cannabis immediately automatically loses the right to their driving license. All this only lends to further health inequalities which appears to be state sponsored. There remains a real lack of evidence to back such existing policies. Meanwhile, the real and immediate risks of the use of recreational Cannabis at the moment are those of getting caught and ending up in court. A clean police record still may tip the balance in an employment interview. Full recreational liberalization of the use of Cannabis—if considered, would have to be tampered by caution with similar restrictions as for alcohol such as when it comes to driving under the influence of Cannabis. The evidence emanating so far from countries where liberalization has gone ahead such as Canada do not show any cause for concern nor has there been any real reconsideration of the decision taken.
