A 10-year-old La Mesa boy was the key witness Wednesday in the jury trial of Russell Charles Cilibraise III—facing a possible 8-year prison sentence if convicted of lewd and lascivious acts with a child at the Vons near City Hall. The case involves a June 2011 incident in the bathroom of the La Mesa Springs Vons supermarket. The boy testified Wednesday in El Cajon Suuperior Court that he opened up the men's bathroom only to see Cilibraise sitting on the toilet, with his 2-year-old son on his lap. The witness alleges that the toddler was facing away from Cilibraise, and gripping the man's "privates" with both hands, and making an up-and-down movement with his hands. Cilibraise's eyes were somewhat closed, and his arms were dangling at his sides while the toddler was on his lap, the youngster said in Judge Joseph Brannigan's court. The witness was with his older brother, who was 12 at the time, and the two quickly entered the women's bathroom, where the older brother testified that his younger brother began recounting what he saw. They emerged from the women's bathroom and were joined by their mother, and two other siblings who were also at the store, he said.
The five of them walked to their La Mesa home, where the mother told her husband, who then drove the witness back to the store in order to notify management of what his son said he had seen. The witnesses' father said he was angry when he heard the story "because they left the store without notifying management of the incident." He said he returned to Vons because he "felt like I might be saving someone's life. I thought I should do the right thing. I wanted to show my kids to do the right thing." The younger of his sons said that he only peeked his head inside the bathroom, and did not enter. He said the entire time he saw Cilibraise and the baby lasted "two slow seconds." When asked by Deputy District Attorney Claudia Grasso, he identified Cilibraise in the courtroom as the man he saw in the bathroom. He admitted that he was joking and laughing with his older brother about the incident because he "didn't really know it was bad," and said he "had never seen it before." Upon cross examination from Cilibraise's attorney, Cassandra Hearn, the witness said he had never seen a man's penis in an erect state, and the he could not tell whether Cilibraise had an erection. He did say that Cilibraise was sitting far back on the toilet, and that the baby was sitting more towards the defendant's stomach than his knees. He said that he saw "only the top" or Cilibraise's penis (referred to as privates) and did not see his scrotum, when asked by Hearn. When the witness and his father returned to the store, they spoke with store management, who eventually called the police. The witness and his father then gave a statement to the police. Surveillance footage from the time of the incident was played for the court. The footage contradicted some of the witness's testimony, including details on which bathroom was entered first. The witness also said that his older brother went to the bathroom in the women's restroom when they were in there, a statement that the older brother later denied in his own testimony. Another facet of the testimony hinged on the lack of cleanliness of the women's bathroom. According to testimony from the brothers, as well as from a former Vons employee tasked with cleaning the bathroom, the women's bathroom was very dirty at the time of the incident.
The witness said that there was fecal matter on the floor near the toilet and near the sink. The former Vons employee later confirmed this, adding that there were also streams of urine on the wall and all over the floor.
Surveillance footage showed at least three different women entering and quickly leaving the women's bathroom, while members of the family were waiting in an area outside the bathrooms.
Footage also showed the brothers playing around and joking, and even showed the witness apparently demonstrating what he had seen, standing with his hands out in front of him and moving his hips back and forth.
The witness said in his testimony that he was "making a parody out of it." Cilibraise is shown on the footage both entering and leaving the restroom. Upon his departure, the rest of the witness's family is also outside of the bathroom area. The witness's older brother also identified Cilibraise as the man that he saw leave the bathroom carrying a toddler.
The older brother's testimony included what his brother had told him. "[My brother] told me he saw a man chilling on the toilet with a baby in his lap," the older brother said. "He said the baby was playing with his thing, like a joystick." The older brother said the two were joking, both about the alleged incident and the nature of the women's bathroom, where he also described "the poop on the floor."
He said he believed his brother was telling the truth.
"If he was lying, he wouldn't have been laughing that much," he said. Their father testified that the story of the incident he heard from his wife and son—and the stories recounted to officers later that day and the next day in a separate interview—were consistent.
Cilibraise faces a sentence of three to eight years in state prison if convicted. Testimony in the trial will continue Thursday.

Coming out to your parents is one thing, but imagine what it's like to come out to your child.
As every LGBT person knows, coming out of the closet isn’t some grand global event that happens once in your life. It’s not as though when you do it, an email circulates to the entire world and everyone instantly knows. Instead, it’s the beginning of a lifetime of coming out. You meet new people, get new jobs, move, etc. It doesn’t mean you have to introduce yourself in every situation as gay — “Hi, I’m Frank, nice to meet you; also, I suck dick.” But inevitably some situations will call for you to claim your gayness. Having a child is almost like hanging a big sign on you that says “YES, CLEARLY WE ARE GAY BECAUSE WE ARE TWO MEN/TWO WOMEN WITH A CHILD.” Because we’re parents, every time my spouse and I go into a restaurant, store, theme park (kill me) it’s pretty obvious to everyone around that YES, WE ARE A GAY COUPLE. Fortunately, we don’t give a shit. Fortunately, we think we’re perfect just the way we are. Unfortunately, not everyone agrees. We have no problem acknowledging our sexuality when it comes up. However, with our 4-year-old, it has started to come up among his friends. They are keen to observe that things are different in our family, and like all 4-year-olds, they’re full of questions. Recently, our son’s “girlfriend” was over for a play date and we were eating lunch. She asked me, in reference to my spouse, “Does he live here too?” I responded with “Of course he does!” She gave me a very unimpressed “Oh.” Then I could see her cute little brain spinning and she said “So Briggs has two daddies,” and I gave my automatic reply, “Yes he does. S ome people do. ” And that was the end of that conversation. “Some people do” is my favorite thing to tell kids. It’s simple, it’s concise, and best of all, they buy it. When your child is 4, there’s no reason to get into what being gay means. We openly use the word, because after all, it’s not a bad one. He has yet to ask us about it; to him it’s just the norm. One day, however, he is going to come to us and have a ton of questions. To be honest, I’m more terrified of that than I was of coming out to my parents. Coming out to our son will be tricky, because as in any close family, it means he will be identified with the word “gay,” regardless of his sexuality. Not all the kids he will encounter will be nice about it. We will arm him with a thick skin and a sharp tongue, but that’s about all we can do. I have given it some thought, and the approach will probably be “Son, most boys grow up and like girls, but some boys grow up and they like boys.” I want it to be descriptive but not overly descriptive. If he asks sexual questions, I will just throw on Brokeback Mountain and let him figure it out for himself. No matter what happens, nothing will prepare me for that moment, and I have to show him that I am proud of who I am and that there is nothing wrong with being gay. After I’m done with that, I’ll explain that because he has two dads, he has also always had the best hair, to which I expect a “thank you.”

A seven-year-old girl, Nneka (not real name) has narrated how her father usually play with her private part and insert his manhood in her mouth.
The victim, who lives with her parents at their Ojokoro Housing Estate, Meiran, Ijaiye, Lagos, said the father would pay her after making love with her.
The primary three pupil while narrating the incestuous incident to newsmen recently said, “My daddy usually gives me money after touching my private part or putting his penis in my mouth. He touches my private part when my mother is outside washing clothes or when she is not in the house.”
According to Vanguard report, the victim’s father, whose identity was given as Chukwuemeka Odunzie, allegedly started defiling his daughter early last year.
Narrating her ordeal, the victim’s mother, Mrs Odunzie, said: “Last year, my son told me that his younger sister was fond of playing with her private parts. It sounded strange that a seven-year-old child would be doing that.
“I will talk to her, scold her and sometimes beat her. There was a time I told my husband.
“All he said was that if she was acting strangely I should take her to any of these white garment churches. I was alarmed when one day, while we were in the sitting room, she started touching and playing with herself.
“Immediately, I called her inside the room and asked her what the problem was. I asked her if anyone was fiddling with her private parts. She said it was her father that always touched her private parts and that after touching her private parts, he would give her money.
“I confronted my husband when he returned from work but he denied vehemently. I reported a case of defilement to Ebenezer Divisional Police and the policemen invited my husband for questioning.
“He was arrested later by the police, who gave me a report to take my daughter to the hospital. The doctor said there had been no penetration, but that there is an opening in her vagina and advised that the victim be tested for infection.
“By the time we came back from the hospital, the IPO said it was a family issue and that we should go home and settle
the case.
“Members of his family were shouting, saying that I had no right to report the case to the police, that it was a family issue that should be treated as one. They pressurized me till I withdrew the case, after which he promised not to defile our daughter again.
“After I withdrew the case, my husband began to beat the children at the slightest provocation. And at times, he would beat them for no tangible reason.
“Two weeks ago, it happened again. I asked her what she did for her father that made him give her money without giving her siblings. That was when she said that daddy gave her the money after touching her private part.
“Her siblings said it had been ongoing for a while and that they refused to tell me because the last time they did, their daddy kept beating them.
“Her brother said whenever I was not around, or I was outside washing clothes, daddy would send him and his other siblings inside the bedroom, while he would ask the victim to kneel down in between his legs and bend her head towards his manhood.
“She also confirmed that after touching her, daddy would put his penis in her mouth.
“There was even a time my daughter was caught in the act with a four-year-old boy, who is a neighbour’s child.”
The accused, Chukwuemeka Odunzie, admitted that it was only once he abused his daughter and that he was not doing it for diabolic reasons.
