A teenage boy was told by school leaders that he had to “tolerate” undressing in front of a female student and to make it as “natural” as possible, according to a blockbuster lawsuit filed in a Pennsylvania federal district court.
The lawsuit, filed Tuesday by Alliance Defending Freedom and Independence Law Center, alleges the Boyertown Area School District shamed the teenage boy and violated his personal privacy. They are also alleging sexual harassment.
“No school should rob any student of this legally protected personal privacy,” ILC attorney Randall Wenger said. “We trust that our children won’t be forced into emotionally vulnerable situations like this when they are in the care of our schools because it’s a school’s duty to protect and respect the bodily privacy and dignity of all students.”
In the case of “Joel Doe” – they clearly ignored that duty.
Last Fall, the teen boy was standing in his underwear inside a locker room at Boyertown Area High School preparing to change for a physical education class.
“He suddenly realized there was a member of the opposite sex changing with him in the locker room, who was at the time, wearing nothing but shorts and a bra,” the lawsuit states.
The boy, along with several of his classmates reported the incident to Assistant Principal, named as a defendant.
“Dr. Foley indicated that the legality was up in the air but that students who mentally identify themselves with the opposite sex could choose the locker room and bathroom to use, and physical sex did not matter,” the lawsuit states.
The teenage boy asked the assistant principal if there was anything that could be done to protect him from the situation.
“Dr. Foley told Joel Doe to ‘tolerate’ it and to make it as ‘natural’ as he possibly can,” the lawsuit states.
As the boy got up to leave the office, the assistant principal allegedly told the youngster to again “be as natural as possible.”
Even more disturbing, parents were not told of the school district’s decision to let students of one sex use the locker rooms and bathrooms of students of the opposite sex.
“The District’s directive to Joel Doe was that he must change with students of the opposite sex, and make it as natural as possible, and that anything less would be intolerant and bullying against students who profess a gender identity with the opposite sex,” the lawsuit states.
The young man’s parents made an appointment to school leaders and were told that the district is “all-inclusive.”
The lawsuit alleges that Foley told the boy’s parents their son could use the nurse’s office to change – if he had a problem changing in front of girls.
Principal Brett Cooper, also a defendant, backed up the assistant principal’s solution.
Supt. Richard Faidley suggested if “Joel Doe was uncomfortable changing with those of the opposite sex, or with using the nurse’s office, then he could just withdraw from school and be home schooled.”
The school district has yet to respond to the lawsuit.
Should the school district be found guilty, they should immediately fire Faidley, Cooper and Foley. Their alleged behavior is beyond repulsive.
But the lawsuit clearly illustrates the radical sex and gender narrative being forced on every public school locker room in the nation.
And as evidenced by the school district’s behavior, resistance to this perverse indoctrination seems to be futile.

SINGAPORE — A 16-year-old boy who was celebrating his birthday with his friends forcibly stripped another 14-year-old boy who had come up to the group to say hello.
The 16-year-old helped restrain the victim and filmed the incident, which came to the victim's school disciplinary master's attention after the video was circulated on social media.
Both the 16-year-old and his 20-year-old male friend, who also helped restrain the boy, admitted to the acts of bullying on Wednesday (15 December). Each pleaded guilty to a charge of molest.
Both were ordered to be assessed for their suitability for probation, and will return to court on 28 January. Probation is a community-based sentencing option that is usually given to young offenders who will not have a criminal record upon completing their term.
Another 16-year-old boy, a friend of the accused persons who had come up with the plan to bully the victim, had earlier pleaded guilty to a count of molest and is awaiting his sentence.
None of the parties can be named to protect the identity of the victim.
On 3 March last year, at about 11pm, the trio, a 14-year-old girl, and an unknown man were celebrating the 16-year-old accused's birthday at a barbecue pit in Yishun.
The victim, who passed by the pit on his e-scooter, approached the group to say hello. Court documents did not state if the victim was acquainted with anyone in the group.
The 16-year-old friend then came up with the idea to pull down the victim’s pants, and his two male friends agreed to join in.
At about 12.45am the next day, the 20-year-old man restrained the victim, pulling him to the ground. He shouted, “faster come and pull his pants”. He undid the victim's belt, and pulled down his pants and underwear.
The 20-year-old then hung the victim's pants on a sheltered walkway and hid the underwear in the bushes. The group ignored the victim's plea for them to stop, and the teen girl recorded the victim with her mobile phone.
While the victim’s lower torso was naked, the group again restrained him and the 20-year-old removed his shirt. The victim managed to break their hold and hid near a bush where it was dark. The 16-year-old accused filmed a second video of the victim having his shirt removed.
The group laughed at the victim and later returned his clothes. The girl forwarded the two videos to the others in her group.
The victim felt angry and asked the group to delete the videos. The 20-year-old man said he would, and promised not to circulate the videos.
However, one of the videos was posted on social media.The victim’s discipline master was informed about the video and he lodged a police report.

The Internet is outraged at a video that’s quickly going viral in which a mother films her young son being spanked with a paddle by two employees at the child’s school . The video is distressing, as both child and mother, Shana Marie Perez, are clearly upset. It’s tough to watch, and if you choose to press play, please proceed with caution.
There’s a lot of anger to be felt when you see a video like this, and that anger is incredibly justified. The question many of us may be asking ourselves is, “How could someone let this happen?” And, more often than not, that question is directed at the child’s mother, who seemingly stood by and did nothing while her son was beat at school.
But things are not always as simple as they seem. The accompanying text to the video posted on Facebook makes it clear that Perez felt helpless to stop what was happening. She indicates that if she said they couldn’t do it, her son would be suspended, and if that happened, she would be jailed for truancy. We have no way of knowing whether that scenario would have played out if she had stopped the beating, but what’s important is that she believed it would.
Perez was faced with many parents’ worst nightmare: a situation in which she felt powerless to help her child. Georgia is one of 19 states that still allow corporal punishment in schools . And Georgia state law does not make it easy for a parent to opt out of corporal punishment for their child. The law states , “If a parent or guardian does not approve of the use of corporal punishment against their child, they must provide a written statement from a physician stating that it would be detrimental to the child’s health.”
Where our outrage should be directed when incidents like this happen is not at the parents who feel trapped and forced to let schools take action they don’t agree with but at the systems in place that make it difficult, if not impossible, for parents to advocate for their children. The process for a parent to opt out of corporal punishment for their child varies by state, and many parents may not even realize that its use is still allowed in their state. They may not know that they needed to think about opting out in the first place until it’s too late and they’re faced with a situation like Perez found herself in.
We send our children to school for them to learn, grow and, hopefully, be safe. We don’t expect that the school itself will be the place that administers harm or abuse to our children. But if we’re really outraged, we should be looking up the laws in our own states and working to change outdated and harmful laws where they still exist. Because we know better than we did 100 years ago, or even 50 years ago. Today we know that spanking is detrimental to a child’s health and well-being. We have better ways of handling children that we deem to be misbehaving.
No parent should be forced to have to watch their children endure a beating at the hands of the people tasked with keeping them safe. Now it’s on the rest of us to ensure it doesn’t happen again.
