1. Introduction

Welcome to Beter vista (the "Application"). This Application is developed and operated by Andrii Filoniuk (the "Developer").

By downloading, installing, accessing, or using the Application, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you must not use the Application.

2. Description of Service

The Application provides a productivity tool that combines habit tracking, a focus timer (Pomodoro technique), and gamified progress statistics. The Service is offered free of charge for personal, non-commercial use.

3. User Accounts and Data

• No Account Registration: The Application is designed for local use on your device. You are not required to create a user account to use the core functionalities.
• Data Collection and Processing: Your use of the Application involves the collection and processing of data as described in the Application's separate Privacy Policy. By using the Application, you consent to such data practices.
• Third-Party Services: The Application integrates with third-party services (specifically Google Firebase for analytics and crash reporting). Data transmitted to these services is governed by their respective privacy policies, which are linked in our Privacy Policy. Please note that you cannot directly delete data once it has been transmitted to these third-party services from within the Application. For requests regarding data held by these third parties, you must contact them directly in accordance with their policies. To stop all data collection by the Application, you must uninstall it.

4. Acceptable Use

You agree to use the Application only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Application. You may not:

• Attempt to reverse engineer, decompile, or disassemble the Application.
• Use the Application in any manner that could disable, overburden, damage, or impair the service.
• Use any robot, spider, or other automatic device to access the Application for any purpose without our express written permission.

5. Intellectual Property

All rights, title, and interest in and to the Application (including but not limited to all software, code, design, text, graphics, and the selection and arrangement thereof) are and will remain the exclusive property of the Developer and its licensors. The "Beter vista: focus control" name and logo are trademarks of the Developer.

6. Disclaimer of Warranties

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. THE DEVELOPER SPECIFICALLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE DEVELOPER DOES NOT WARRANT THAT THE APPLICATION WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OR INABILITY TO USE THE APPLICATION; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN.

8. Modifications to the Service and Terms

The Developer reserves the right to modify, suspend, or discontinue the Application (or any part of it) at any time with or without notice.

The Developer may revise these Terms from time to time. The most current version will always be posted within the Application. By continuing to access or use the Application after revisions become effective, you agree to be bound by the revised Terms.

9. Termination

Your right to use the Application will terminate automatically if you violate these Terms. You may also terminate your agreement with the Developer at any time by ceasing all use of the Application and uninstalling it from your device(s).

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Developer resides, without regard to its conflict of law provisions.
