BLOOM USER AGREEMENT



Welcome to Bloom, a beauty video community platform. This User Agreement ("Agreement") is a legal contract between you ("User," "you," or "your") and Bloom Inc. ("Bloom," "we," "us," or "our") governing your use of the Bloom mobile application and related services (collectively, the "Service").

1. ACCEPTANCE OF TERMS

By downloading, installing, accessing, or using the Bloom app, you agree to be bound by this Agreement and our Privacy Policy. If you do not agree to these terms, do not use our Service.

You must be at least 13 years old to use Bloom. If you are between 13 and 18 years old, you represent that you have obtained parental or guardian consent to use the Service.

2. DESCRIPTION OF SERVICE

Bloom is a mobile application and online platform that allows users to:

  • Create, upload, and share beauty-related video content
  • Discover and view beauty tutorials, reviews, and tips
  • Interact with other users through comments, likes, and follows
  • Purchase beauty products through integrated shopping features
  • Participate in beauty community discussions

3. USER ACCOUNTS

3.1 Account Creation

You must create an account to access most features of Bloom. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your account information
  • Keep your login credentials secure and confidential
  • Be responsible for all activities under your account

3.2 Account Suspension and Termination

We reserve the right to suspend or terminate your account at any time for:

  • Violation of this Agreement

4. CONTENT AND INTELLECTUAL PROPERTY

4.1 User-Generated Content

You retain ownership of content you create and upload to Bloom ("User Content"). By posting User Content, you grant Bloom a worldwide, non-exclusive, royalty-free, transferable license to:

  • Use, display, reproduce, and distribute your content
  • Create derivative works for promotional purposes
  • Allow other users to share and interact with your content

4.2 Content Guidelines

All User Content must comply with our Community Guidelines and must not:

  • Contain false, misleading, or harmful beauty advice
  • Infringe on intellectual property rights
  • Include hate speech, harassment, or discriminatory content
  • Promote dangerous beauty practices or unsafe products
  • Contain explicit, violent, or inappropriate material
  • Violate any applicable laws or regulations

4.3 Content Removal

We reserve the right to remove any User Content that violates this Agreement without prior notice. We are not obligated to monitor content but may do so at our discretion.

Bloom and its logos, trademarks, and service marks are owned by Bloom Inc. You may not use our intellectual property without written permission.

5. PROHIBITED CONDUCT

Users are prohibited from:

  • Impersonating others or creating fake accounts
  • Spamming, soliciting, or engaging in unauthorized commercial activities
  • Attempting to hack, disrupt, or damage the Service
  • Collecting user information without consent
  • Using automated tools to access the Service
  • Promoting competing beauty platforms
  • Sharing content that promotes harmful beauty standards or body dysmorphia

6. PRIVACY AND DATA PROTECTION

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into this Agreement by reference.

7. SHOPPING AND TRANSACTIONS

7.1 Product Purchases

Bloom may facilitate purchases of beauty products through third-party retailers. We are not responsible for:

  • Product quality, safety, or authenticity
  • Shipping, returns, or customer service
  • Payment processing issues
  • Disputes between users and retailers

7.2 Creator Monetization

Eligible creators may monetize their content through:

  • Sponsored content partnerships
  • Affiliate marketing programs
  • Direct fan support features
  • Brand collaboration opportunities

All monetization activities must comply with applicable disclosure requirements and our Creator Guidelines.

8. DISCLAIMERS AND LIMITATIONS

8.1 Service Availability

Bloom is provided "as is" without warranties. We do not guarantee:

  • Continuous, uninterrupted access to the Service
  • Accuracy or reliability of User Content
  • Compatibility with all devices or operating systems

8.2 Beauty Advice Disclaimer

Content on Bloom is for informational and entertainment purposes only. We do not provide professional beauty, health, or medical advice. Always consult qualified professionals before trying new beauty products or procedures.

8.3 Limitation of Liability

To the maximum extent permitted by law, Bloom shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, data, or business opportunities
  • Damages arising from User Content or third-party actions
  • Any damages exceeding $100 or the amount paid to us in the past 12 months

9. INDEMNIFICATION

You agree to indemnify and hold harmless Bloom, its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

  • Your use of the Service
  • Your User Content
  • Your violation of this Agreement
  • Your violation of any third-party rights

10. DISPUTE RESOLUTION

10.1 Governing Law

12.3 Effect of Termination

Upon termination:

  • Your right to use the Service ends immediately
  • We may delete your account and User Content
  • Provisions regarding liability, indemnification, and dispute resolution survive

13. GENERAL PROVISIONS

13.1 Entire Agreement

This Agreement and our Privacy Policy constitute the entire agreement between you and Bloom.

13.2 Severability

If any provision is found unenforceable, the remaining provisions remain in full force and effect.

13.3 Assignment

We may assign this Agreement without your consent. You may not assign your rights under this Agreement.
