State superintendent candidate April Grace responds to 'insinuations'
SHAWNEE — A month after formally announcing her bid for state schools superintendent, a top candidate is facing a crisis that could jeopardize her campaign.
April Grace, the superintendent of Shawnee Public Schools since 2016, came under fire after an assistant athletic director was accused of sexual misconduct with a 17-year-old boy.
"You’re done," one critic posted on her campaign Facebook page.
"She’s not protecting anyone but herself and her job. She allowed children to be in harms way," another critic wrote.
That criticism was sparked by an investigator's statement in an arrest affidavit that an assistant athletic director, Ron Arthur, has been accused before. 
Arthur, a former boys basketball coach, denies wrongdoing. He has been suspended with pay since Aug. 2.
The investigator, a Pottawatomie County sheriff's deputy, reported in the affidavit that she used search warrants to obtain school disciplinary records.
"I located 8 admonishments and suspensions of Ronald Arthur for his vulgar and sexual comments to male students and vulgar comments about female students, allegations of having inappropriately touched a male's buttocks, sending inappropriate text messages to students and having contact with students alone when he was not allowed to per his previous reinstatements," Deputy Amber Soule told a judge in the affidavit.
Grace said Thursday that the investigator took the records out of context.
"Transparency in the case of personnel matters is difficult," she said in a lengthy statement issued by the district.
"While we would welcome the opportunity to provide an in-depth response to the allegations and insinuations that there is wrongdoing at the district level, we cannot comment on the specifics as it is against the law."
She explained that a superintendent may suspend an employee with pay while an allegation is being investigated.
She said one incident could result in all or some of the following being put in an employee's file: "Letter of Suspension, Letter of Expectations, Reprimand, and Admonishment and Plan of Improvement."
She also said the school district does not condone "the alleged behavior by Mr. Arthur or any school employee entrusted with student well-being."
"We remain committed to assisting law enforcement with their investigation while also conducting our own internal investigation," she said.
The sheriff's office began its investigation in July after a former student reported he had met with Arthur twice for oral sex on a dead-end road.
He was 17 at the time of both encounters.
The first time was after the two chatted on the social networking app Grindr around the time of graduation in May, the deputy wrote in the arrest affidavit. "Arthur said he had seen him around school," the deputy wrote.
The second time was July 22, again after both were on the Grindr app.
Arthur has acknowledged sexual contact with the individual but described it as consensual and after graduation, his attorney said.
"He did not engage with any students," the defense attorney, Shelley Levisay, said last week.
The deputy told the judge the alleged victim was still involved in student activities as an athlete at the time of the first interaction. The defense attorney said the event "the sheriff's office is trying to use to convert him into a student" was not school sponsored.
"No Shawnee Public School funds were used," the defense attorney said. "There's not a crime here."
Arthur was taken into custody at the high school on July 24 by the sheriff's office, the school superintendent revealed in her statement.
"Mr. Arthur called me after he was returned to the high school campus by the Sheriff's office," Grace said. "He stated that he refused to answer questions without an attorney present. I instructed him to not return to the high school campus and report to the Administration building on Monday morning."
She said she immediately suspended Arthur on Aug. 2 after the deputy told the school district's attorney there were allegations of inappropriate conduct with a student within the last year.
Arthur turned himself into the Pottawatomie County jail last week after a judge signed a warrant for his arrest on complaints of forcible sodomy, lewd acts with a child, child sexual abuse and use of technology to solicit sexual conduct with a minor.
Newly unsealed search warrant records reveal that Shawnee police also looked into accusations against Arthur. The first time dates back to 2007.
"The incident was a juvenile male had come forward about Mr. Arthur making vulgar comments toward students," the sheriff's deputy wrote in a request for school records.
"Mr. Arthur had stated he wanted to take this student upstairs with him. At some point, Mr. Arthur then fondled the male student's testicles."
A retired Shawnee police detective, Tony Grasso, told The Oklahoman the student was on a basketball team coached by Arthur.
"I got a statement. ... I talked to several other students. They said that they were confronted by the coach ... and that they too had received ... a 'ball' check," Grasso said.
The students said the checks had taken place at practice and at parties, he recalled.
The retired detective said he had to go to a grand jury to get information because of interference from the school district. 
Grasso also recalled he spoke directly to Richard Smothermon, the district attorney in Pottawatomie County at the time.
"He said he wasn't going to prosecute the case," Grasso recalled. "He said, 'I'm not going to go forward with this.' And I just looked at him. And that was it. ... We had to drop it."
Smothermon said he does not remember that. DA records reflect it was an assistant district attorney who declined prosecution. The records give insufficient evidence as the reason.
In the search warrant request, the deputy also reported there was another incident reported to police regarding sexual abuse allegations against Arthur.
"The juvenile male at the time reported ... Arthur had touched him inappropriately on his buttocks," she wrote.
Those earlier allegations were brought to the school district's attention, she also indicated.
"He has been allowed to be around students for the last 14 years while the Shawnee Public Schools knew he had sexual abuse allegations against him from current students at the time," she wrote.
Taken as evidence from Arthur's employee file on Aug. 4 were three letters from parents, 18 letters from students, a reinstatement and documents described as eight "suspension/admonishment letters" dating back to April 2, 2007.
Also taken was his resignation letter as basketball coach. Arthur stepped down in 2020 as the boys basketball coach after 16 seasons. 
The deputy told The Oklahoman last week that more former male students have come forward.
District Attorney Allan Grubb said a decision will be made on charges over the incident in May after information is reviewed. He noted more investigation is needed.
"They haven't had time ... to get the electronic records from Grindr," the DA said.
He also said prosecutors will review a change in the law to determine if Arthur can be charged over the 2007 incident.
"Given the time he was there, we would ask that all victims come forward to hold this man accountable to the full extent of the law," Grubb said.
Grace is one of three Republicans seeking to take over when Joy Hofmeister leaves office because of term limits. The election is next year.
She reported having raised more than $110,053 in cash and in-kind contributions as of June 30.
Grace has spent over 30 years serving children and families in Oklahoma, according to her campaign Facebook page. She began her career as a high school science teacher and coach.
Grace is the 2021 Oklahoma Superintendent of the Year. Fellow district leaders chose her for the award.
Cox has run twice before as a Democrat.
Hofmeister last week also issued a statement about Arthur.
"It is unconscionable for anyone to use their position of authority to take advantage of a young person, and these are horrific allegations," she said. "We are continuing our investigation and will be recommending emergency suspension of this teacher's certification."
