Freedom, Commerce, Bodies, Harm: The Case of Backpage.com

Full Text
PDF (free download)

Abstract:  This article situates lawsuits against Backpage.com in the context of changing laws and norms of sexual commerce and trafficking, and of evolving legal interpretations of Section 230 of the Communications Decency Act. Section 230 has been used repeatedly to shield internet service providers such as Backpage.com from liability for content generated by third parties that has led to criminal harm to others; in this case, the trafficking and commercial sexual exploitation of minors. Moving to a critique of the law as at times grievously detached from the realities it addresses, I compare the legal strategies and decisions in three prominent cases brought against Backpage.com in St. Louis, Tacoma, and Boston, respectively. This critique identifies the evacuation of gendered bodies and the harm done to them from the court opinions as an example of what Robert Cover has called the “interpretive violence” of the law, and of the judges who interpret and dispense it. I conclude by calling for courts and Congress to act together to disrupt the accumulation of interpretive precedent favoring freedom of commerce and speech over the protection of bodies from harm.

Does anyone know of a gun trading site people are using now that Backpage is defunct? I know about the auction sites, but is there a simple, low-key buy and sell site?
You could sell guns on backpage? That's sketchy. I thought backpage was just for hookers and meth
In Arizona backpage was the #1 place to buy and sell. It wasn't sketchy at all. Arizona is probably the best state for gun laws and it was easy, since there are no regulating laws in addition to federal regs.
Well most states don’t regulate private party transactions, backpage was no different than Armslist.
Armslist, but be prepared for every fudd in the country to offer you 60% less than what you’re asking.
But people think their custom used gen 3 Glock 19 with 30000 rounds through it is still worth 500$. People ask way to much
Unless you’re buying then expect new plus 25% markup
I offer 80% of asking on just about everything, it works.
My part of the country has a local classifieds site sponsored by Nex-Tech Communications. Typically there are between 400 and 600 firearms listings at any time, and listings only last a week. Individuals can post for free, businesses can post but they have to pay for each listing.
Armslist, slightly less sketchy then Backpage
