第59-61集 － 剪布JR - CFI
Loewenstein請容許我先引用西方先賢嘅說話，以佢哋當時社會環境，敢去提出喱啲見解，實屬不易，係喱一群智者令我哋能夠享受今日自由嘅空氣。

如立法與行法之權集一人之身或由司法機關所有，則無自由...若司法之權不從立法與行法之權分開，亦無自由... —— 孟德斯鳩
另外我亦希望以《基本法》嘅一啲條文作引子，嚟「不專業略述」之後立法同司法之間嘅關係，喱個應該係喱一篇最長嘅文嚟，係用作資料參考。
全國人民代表大會授權香港特別行政區依照本法的規定實行高度自治，享有行政管理權、立法權、獨立的司法權和終審權。
香港特別行政區享有行政管理權，依照本法的有關規定自行處理香港特別行政區的行政事務。
香港特別行政區享有立法權。
全國人民代表大會常務委員會在徵詢其所屬的香港特別行政區基本法委員會後，如認為香港特別行政區立法機關制定的任何法律不符合本法關於中央管理的事務及中央和香港特別行政區的關係的條款，可將有關法律發回，但不作修改。經全國人民代表大會常務委員會發回的法律立即失效。該法律的失效，除香港特別行政區的法律另有規定外，無溯及力。
香港特別行政區享有獨立的司法權和終審權。
香港特別行政區立法會主席行使下列職權： ...
( 六 ) 立法會議事規則所規定的其他職權。
香港特別行政區立法會行使下列職權：
( 一 ) 根據本法規定並依照法定程序制定、修改和廢除法律；...
立法會議事規則由立法會自行制定，但不得與本法相抵觸。
本法的解釋權屬於全國人民代表大會常務委員會。
本法的修改權屬於全國人民代表大會。
如果真係眼利，你會發現我夾咗條第17(3)條，我係有用意嘅。
一、行政管理權：行政長官係委任，打中央工，即係有一定閹割。
二、立法權：第17(3)條，有一定閹割。
三、司法權：喺自由與權利提過，第158條同第159條同一啲CFA嘅判決，亦令到有一定閹割。
喺一個殘缺嘅三權、不能與時並進嘅憲制性文件、行法與立法之間不謀而合，也許正如孟德斯鳩所講，there is no liberty；仲有，因為三權當中，只有司法嚴守三權分立嘅時候，變相助長行法同立法壓搾我哋嘅氣焰。

以下開始真係講【剪布JR】
我引用嘅三個案例HCAL 64/2012、CACV 123/2012 同 FACV 1 of 2014，主要係五區總辭同五區公投後，班建制派為制衡喱種抗議方法而去將立法會條例修改，去限制辭職嘅立法會議員半年內不得參選，同埋及後因會內問題引發嘅司法覆核。
有興趣嘅，可以去wiki好不專業咁了解一次成個五區總辭嘅來龍去脈，同睇返剪布後當日嘅新聞。
以下係講故佬模式，可以講判決書 HCAL 64/2012。

當時立法會主席動用《議事規則》第92條嘅權力嚟剪布以終止冗長嘅拉布行動，長毛因此申請司法覆核，認為主席無權終止佢哋發言。
喺未講個官係點講之前，先睇以下《議事規則》第92條。
92. 議事規則未有規定的程序
對於本議事規則內未有作出規定的事宜，立法會所須遵循的方式及程序由立法會主席決定；如立法會主席認為適合，可參照其他立法機關的慣例及程序處理。
另外，亦想請各位望一望以下嘅《基本法》條文。
《基本法》第72條
香港特別行政區立法會主席行使下列職權：
...( 六 ) 立法會議事規則所規定的其他職權。
《基本法》第七十三條
香港特別行政區立法會行使下列職權：
( 一 ) 根據本法規定並依照法定程序制定、修改和廢除法律；...
《基本法》第七十五條第二款
立法會議事規則由立法會自行制定，但不得與本法相抵觸。
咁喺高院嗰陣，個法官就喱個申請講啲咩呢？
48. If there is a right to filibuster, the proceedings of the Legislative Council could be hijacked by a handful of legislators for an indefinite period of time. The legislative process could come to a grinding halt and the Legislative Council would not be performing its constitutional function under Article 73. Giving Articles 73(1) and 75(2) a purposive interpretation, they cannot encompass a constitutional right to filibuster.
不專業翻譯：「若有權拉布，立法會議事便受一些議員無限期持劫，故立法程序終止而使立法會無法履行其《基本法》第73條的責任。以立法原意詮譯《基本法》第73條第1款及第75條第2款，拉布並非是憲法上賦予之權。」
49. ...the court should observe the non-intervention approach both before and after the completion of the legislative process.
不專業翻譯：「不論立法程序處於完成前或後，法庭應遵行不干涉立法之取向。」
50. The adoption of such an approach does not mean the rule of law is compromised. Rather, it is the recognition by the court as to the difference between the judicial process and the political process and the acknowledgment of the constitutional role of the Legislative Council as the master of its own practice and procedure in the application of the doctrine of separation of powers which underlies the Basic Law.
不專業翻譯：「此非彰示法治之妥協。反而是法庭意識到法律與政治程序之別，並尊重立法會執掌其公務以實行《基本法》三權分立的憲制角色。」
55. ...in the context of our Basic Law, I do not see any room for suggesting that there is a constitutional right to filibuster. In the exercise of his authority to preside over meeting under Article 72, the President has a constitutional duty to ensure that proper conduct of business in the Legislative Council is not derailed. How such duty is to be performed, how the power of the President is to be exercised and the relationship between the President and the members as a whole (balancing the interests of different political Parties in the Legislative Council) are matters of politics.
（最重要喱段）不專業翻譯：「...於《基本法》條文意境，我無法找到能支持拉布具憲法賦予權利的根據。就立法會主席於主持議會時行使的權力，主席有憲制上的責任以確保立法會運作不致脫軌。至於主席如何履行其職責、如何運用其權力，以及其與立法會議員之間的關係（如平衡各政黨之利益或訴求）則是政治問題，非法律問題。」
咁當然長毛係唔服喱個判決嘅，最後上訴。下篇文都係會講上訴庭當時嘅法官有咩看法，案件編號 CACV 123/2012。
