The brawl, which saw furniture from busy bars thrown as missiles, broke out in a street popular with diners and drinkers as a Free Palestine demonstration passed by on a sunny July day last year. A witness to the incident told Cardiff Crown Court on Monday she had heard racist remarks directed at those taking part in the demo.




Five men – Jaber Hossin, Daniel Woods, Barry Murphy, Grant Ashcroft and Yussef Asad – deny violent disorder following the incident, which took place outside the Retro and Soda bars in Mill Lane. Their trial opened at Cardiff Crown Court on Monday. Prosecutor Eugene Egan told a jury of seven women and five men the defendants had claimed their actions had been either self-defence or acting in defence of another. Jurors were shown separate video clips of four of the men taking part in what the barrister described as being behaviour “wholly disproportionate” to anything which might have triggered the outbursts. Mr Egan said the violence had taken place “in an area of Cardiff where there are shops and restaurants and libraries and where there would have been families out and about that sunny afternoon”. Mr Egan said: “They used force and violence when it was unnecessary to do so, and the amount they used was wholly disproportionate.” The demonstration in Cardiff that day supported a free Palestine, with Hossin and Asad taking part in a march which began at City Hall before making its way past the castle and down St Mary Street.




Mr Egan said: “Trouble flared up originally in the area by the Walkabout public house. When the protesters marched around the corner by Retro club there was an episode of violent disorder.” Describing what was seen on the video footage, he added: “The defendant Daniel Woods throws a chair (into the crowd). Jaber Hossin catches that chair and throws it back. It’s then caught by Grant Ashcroft, who in turn throws it back into the crowd of protestors.” Mr Egan said Woods later told police he had been hit by someone holding a flagpole and had been spat at by protesters, but admitted to officers what he had done had been “bang out of order”. The court heard Hossin had told police drunk people had thrown bottles at marchers but admitted to police: “This was not the right way to react.” Ashcroft replied “no comment” to police questions, Mr Egan said. Murphy was not captured on video footage, the jury was told, but was on trial because he had admitted to police he had “gone after” a person whom he believed to have thrown a chair and punched them in the back of the head.




And, referring to Asad’s actions, the barrister said: “He uses firstly a chair and then secondly a table multiple times to hit people with.” Mr Egan said Asad originally denied being part of the protest but now admitted he had been there. Hossin, 21, of Corporation Road, Cardiff; Woods, 23, of Farm Close, Tir-y-berth, Caerphilly; Murphy, 34, of Poplar Road, Pontypridd; Ashcroft, 23, of Llewellyn Street, Gilfach; and Asad, 28, from Swansea, deny the charges. Witness Jayne Griffiths, who was dining with friends in Mill Lane at the time, told the court she had seen a drink being thrown and seen racial insults being directed at the protestors by a group of men outside Retro. Giving evidence, she said: “From the bar next door people started shouting ‘f*** off home’.” Asked what sort of tone of voice those remarks were being made with, she replied: “Antagonistic.” And the witness added: “There was quite aggressive chanting from next door, racially – f*** off home, f****** *****. “




It was horrible, really. I am a teacher and it’s not heard around school from the children so I don’t expect it from adults.” Ms Griffiths said she and other members of her party had tried to intervene but – from within a group of six to nine men, whom she described as being aged from mid-20s to early 40s – heard: “**** off you ****s – you don’t know anything about these *****. What would you do if they stabbed you?” Under cross-examination from Hossin’s barrister Ieuan Bennett, Ms Griffiths said she believed the trouble was being caused by the group of men at Retro bar. Mr Egan earlier told the jury: “This was a protest march where there were children taken on it and where some of the protesters were injured. “Provocation is not a defence to this charge. To retaliate is not self-defence or defence of another.” Other than the five men currently on trial, the jury was also told four others had already pleaded guilty to charges in relation to the incident.
