Kmart has been forced to pay Julie Ann Lewis $300,000 after a garden chair she was sitting on in their Nowra store collapsed, causing her to be permanently injuredDespite a warning on the chairs that they were only for domestic use, she carried one from the gardening section to the desk.After putting her USB drive loaded with her photos into the computer Ms Lewis went to sit on her chair, a decision that proved costly. 'She found herself sitting on the floor, still in the chair,' Judge Judith Gibson said.'She looked behind and noticed that the back left leg of the green plastic chair had torn almost completely from the rest of the chair.'In awarding compensation to Ms Lewis, Judge Gibson said that Kmart staff had been aware of the chair shortage for some time. Ms Lewis was reportedly sitting on an $8 green garden chair like the one pictured when it collapsedShe also said the failure of the store to intervene and fix the problem played a major role in the incident. 'To keep the photo lab (and its income) flowing, Kmart and its staff allowed the development of a haphazard system of customers taking chairs for sale in other departments,' Judge Gibson said.'The defendant's failure to provide adequate seating for its customers in the photo lab, training for its staff and regulation of equipment use all play a role in relation to the circumstances of the accident.'The $300,000 awarded to Ms Lewis will cover some of her past and future wages
