Current state law has no mention of bedbugs, but health officials say infestations have become a growing public health problem in the last several years. While bedbugs aren't known to transmit diseases, they can cause itchy bites and take a psychological toll on their victims. They also have economic consequences and can cost hundreds of dollars to eradicate. They're more common in residential buildings, but have also spread to schools, libraries, hospitals and other public institutions. State representatives on Tuesday discussed a four-bill package that defines the duties and responsibilities of landlords and tenants in dealing with bedbugs, clarifies that public health departments can order property owners to correct infestations, and directs the state to develop a model policy for bedbug prevention, management and control.




"It is in oftentimes the landlord-tenant relationship where bedbug infestations tend to fester and go on because individuals are trying to either show cause or fault and worry about the money issues," said Erik Foster, medical entomologist with the Michigan Department of Community Health. He said bedbugs especially impact lower-income populations who have fewer housing choices and may be unable to move or are afraid to report bedbugs for fear of not being able to afford treatments. House Bill 5199 specifies that tenants must promptly notify their landlords in writing of any potential bedbug infestations, and landlords must have the units inspected within five business days. If an infestation is found, the landlord must inspect adjoining units and arrange for pest control within seven days. Tenants would have to grant access to their unit and prepare for treatment. The leasing contract would determine who has to pay for the service. Landlords also couldn't rent a unit that's known to be infected, and would have to disclose upon request whether a unit or adjoining units had been infested or inspected for infestations in the past 18 months.




Requiring early notification from tenants would help prevent the problem from spreading into adjacent units, said Stephen Purchase, vice president at H Inc., which manages two urban loft apartment buildings in Lansing. He said he's dealt with two infestations in the last five years and decided that it was most fair to split the initial inspection and treatment cost 50/50 with the tenants, with the tenants responsible for any reinfestations. While the state health department supports the measures, some property managers, tenant advocates and public health officials raised concerns. Landlords would have to offer reasonable assistance to tenants who aren't able to prepare for the treatment, but they can also charge for those services. "For families who are already living on edge, having to pay these costs could easily push them over the edge," said Jim Schaafsma, housing law attorney with the Michigan Poverty Law Program. He also opposed the fact that tenants could be on the hook for all or a portion of treatment costs, noting that current law places the primary responsibility on the landlord to maintain the property.
