German federal competition authority fines LEGO Germany The German federal competition authority, the Bundeskartellamt, has fined the German subsidiary of the LEGO Group, LEGO GmbH, in a case concerning non-compliance with competition legislation in Germany. The fine amounts to EUR 130,000. The LEGO Group accepts the decision of the Bundeskartellamt and the fine imposed and has given its full co-operation to the Bundeskartellamt during the entire proceedings. The decision of the Bundeskartellamt is in its essence based on the findings from an internal investigation within LEGO GmbH that was initiated voluntarily by the LEGO Group based upon information received from the Bundeskartellamt in February 2014. The investigation, carried out by an external law firm in 2014, revealed the following: • Internal LEGO Group compliance guidelines had not been followed - in a limited number of incidents - by individual employees in the LEGO Group sales team in a certain part of Germany.




• The incidents occurred in 2012 and 2013 • The incidents involved a limited number of retail partners and approximately 20 LEGO® products • Due to the limited scope of the misconduct, the internal investigation indicated that there was no impact on the general consumer price level In November 2014, the LEGO Group submitted these findings to the Bundeskartellamt and took the following actions: • Sanctions were imposed on all employees who were responsible for the non-compliances. This means that some employees are no longer working for the LEGO Group. • An extensive update to the comprehensive training program on competition compliance, which was already in place globally, was initiated and has been executed. LEGO Group Chief Financial Officer John Goodwin comments: “While this non-compliant behaviour only involved a small number of employees in a restricted part of Germany, we want to make it clear that it is unacceptable and not representative of what the LEGO brand stands for,” adding:




“We take the non-compliant actions from the specific LEGO employees as well as the decision of the Bundeskartellamt very seriously and we have taken steps to prevent such conduct again. There should be no doubt that the LEGO Group always adheres to the laws and regulations of all countries. This is deeply rooted in our values and cultural foundation as well as being open, honest and transparent about how we conduct our business to ensure it is done in an ethical manner”. The donation will fund UNHCR education programmes in Chad, Ethiopia, Iran, Kenya, Malaysia, Pakistan, Rwanda, Sudan, South Sudan, Syria, Uganda and Yemen. These 12 countries have some of the largest refugee populations in the world and a primary school age population of more than 1.25 million children, with as many as 50 per cent out of school.




"The support of the LEGO Foundation, which shares a commitment to childhood learning and development, is a tremendous asset for UNHCR's education programme. The generous donation of funding, product and expertise will help us in our work to give refugee children access to the best possible education in some of the most challenging situations," said Amanda Seller, who heads UNHCR's private sector fund-raising section. The LEGO Foundation will also tap into other areas of its business to support UNHCR by providing training for staff that draws on aspects of its education research programme, and aims to foster rich and motivating learning environments for children. UNHCR will apply these learnings for refugee children in some of the most challenging humanitarian settings. The Foundation will also donate LEGO products to refugee children to enhance their play and learning. Over the years, LEGO has donated thousands of play boxes to UNHCR for forcibly displaced children across Africa, Asia, Eastern Europe and the Middle East.
