But never fear — the incredibly awesome machine is up for sale once again. The company that makes chairs beloved by lazy boys everywhere took exception to police in Proctor, Minnesota, linking its good name to a glorified lawn mower confiscated from convicted drunk driver Dennis LeRoy Anderson. Police put the wild ride up for sale last week, but La-Z-Boy Corp. pulled the plug one day before the bidding — which had topped $43,700 — was to end. Police Chief Walter Wobig told us the listing came down at 11 a.m. Monday, about the same time he got a fax from La-Z-Boy.

“I talked to this guy Rand Tucker from La-Z-Boy who asked if we could take ‘La-Z-Boy’ out of the listing and out of the whole thing and to respect the La-Z-Boy trademark,” the chief told us this morning. Wobig said it was a cordial conversation and the two men came to an agreement that the auction could proceed as long as the words “La-Z-Boy” didn’t appear in the listing. Wobig said he also was asked to ensure the winning bidder knows he or she hasn’t bought a La-Z-Boy. So far, so good. But not for long. La-Z-Boy Corp. spokeswoman Kathy Liebmann told us, “The motorized chair used by Mr. Anderson is not a La-Z-Boy chair. Because it’s not a La-Z-Boy, we requested a modification of the name of the listing by the Proctor, Minnesota Police Department. The La-Z-Boy chair and name is one of our most valuable assets and this is a trademark infringement.” Wobig said he had no problem honoring the request. The only reason he put “La-Z-Boy” in the listing is because the media — us included — used the term.

The chief even ran the listing by his attorney beforehand, but the guy didn’t pick up on the legal landmine. “As soon as I hung up the phone, we immediately went on eBay and made the changes. We were happy to comply,” said Wobig. Apparently eBay wasn’t satisfied. Wobig said the new listing was pulled at 8 p.m. Monday. He was back on the phone with Tucker to ask, “What’s up with that?” , had no luck. “eBay just ups and pulls it and I can’t get a hold of eBay. Not a single soul will call this office or respond to us,” Wobig told us, clearly frustrated. The chief reposted the listing again under the title “DWI Chair, Motorized Chair, Racing Chair,” but he lamented having to start over. “There’s a huge difference between $1,000 and the almost $45,000 it was up to,” he said. (Bidding now stands at $5,200.) That’s $45,000 the Proctor City Council could have added to city coffers because, under Minnesota’s forfeiture laws, the money from the sale of seized items goes back to taxpayers.

In a town of just 1,000 or so houses, that’s a lot of dough. Asked if the La-Z-Boy Corp. plans to crack down on several other eBay auctions related to the motorized ‘La-Z-Boy’ that isn’t a La-Z-Boy, Liebmann said, “I won’t comment on those other things at this time.” But the eBay gates of non-La-Z-Boy motorized merchandise have been thrown open. For $67, you can own an original piece of art, like a lovely caricature of Anderson hot-rodding in his vinyl four-wheeler. Anderson himself got in on the action, offering 10 autographed photos of himself in his chair during in happier times and the seat cushion that fits it (Buy it Now for $1,000!). And Minnesota firefighter Sue Graber is auctioning a photo of herself sitting in a non-motorized recliner of an unknown brand. She hopes to raise money for the local volunteer fire department. “I’m asking, if you have money for an autographed photo,” she wrote in the listing, referring to Anderson’s pics, “maybe you could spend it in a little better place.”
