In a judgment published this week, District Court Judge Philip McCann ordered the Shire of Northam indemnify the Education Department for the worker’s compensation payout to former employee Jane Pisan.Ms Pisan was supervising at a youth forum attended by students from Northam Senior High School at the town’s recreation centre in June 2013 when the seat of the $35 “Martin” chair collapsed underneath her as she went to stand up.The council’s recreation manager Colin Hassell bought 270 of the chairs in 2011.He and at least two other staff assembled them in accordance with instructions.During a trial in January, Judge McCann heard evidence of previous cases of the chairs collapsing — including testimony from former Nationals leader and State MP Max Trenorden that a “Martin” chair had collapsed as he watched a netball game in 2012.A structural engineer gave evidence that in his opinion, the chair was ill-designed and ill-suited for use on polished floors.Judge McCann found the cause of Ms Pisan’s accident was the susceptibility of the base of the chair to flex when under a normal load, which caused the legs to spread and the fixings to shear off.“
They suffered from a latent structural defect which was endemic to their use on polished and slippery floors,” Judge McCann said.Judge McCann found that the shire, through its employees, knew there was a problem with the chairs that pointed to a design or structural issue and that they “had a tendency spontaneously break up into two pieces when sat on”.He said about a dozen had been disposed of because they had failed in similar ways, though there had been no official incident reports filed.“One would have thought that the unceremonious circumstances of Mr Trenorden’s incident, and others like it, would have warranted some king of record being made, at least when the broken chair was disposed of,” Judge McCann said.“Be that as it may, the existence of the problem cannot, or should not have, gone unnoticed.”The chairs were completely replaced by the council later in 2013.A spokeswoman for Ikea WA said the business did not want to comment on the case, but confirmed the chairs continued to be sold.
