The platform fell to the concrete floor below and Jaeger, then 26, suffered a severe fracture of his right thigh bone (femur) and claimed he also injured his back.In an email this week, the city's trial counsel for the case, Norman Barry said, "The City of Elmhurst accepted responsibility for the negligence of an employee that caused regrettable injuries to Mr. Jaeger."Still, Barry said the city was surprised by the amount of the jury award and may appeal or seek other post-trial relief.According to Jaeger's attorney, Joshua Weisberg, the city had argued that Jaeger's fracture healed well and that his loss of income was minimal since he worked for a small family business, A Accurate Door Service, Inc. of Aurora, and stood to take over the company with other family members eventually.Christine Davis of the Illinois Jury Verdict Reporter confirmed the verdict is a state record for a fractured femur and soft tissue back injury and a DuPage County record for a non-medical malpractice personal injury verdict for a single plaintiff.
The $4.16 million dollar award included $1.86 million for lost earning capacity, $1.3 million for pain and suffering and $1 million for loss of a normal life.Jaeger's attorney Weisberg said the award was fair. "It's not a windfall," Weisberg said. "It's fair compensation for what the city did to this guy.""He was a 26-year old with two young children," Weisberg said. "Now he's a 29-year-old with chronic pain."Weisberg said Jaeger couldn't go back to work as a garage door service man. "He's got a disability and is restricted," Weisberg said. "He can't lift over 70 pounds and he can't climb ladders."Barry said the city's insurance will cover the loss.
