The landlord’s maintenance responsibilities according to the Rental Housing Act are: 1. That the condition of the property at the onset of a lease must be fit for the purpose for which it is let. 2. The landlord must maintain the property in accordance with all health, safety and local law regulations. 3.Repairs to the property must be done within 30 days of being told that they are necessary, unless there is a mutual agreement between the tenant and landlord that these will be done at a later stage. 4. While the landlord is repairing the property the tenant should be given a remission in rent to compensate for any inconvenience caused.
An example of what falls under the landlord’s maintenance responsibilities includes the general fixtures and fittings. If the door handles or locks break, if the window fasteners are rusted through, or the garage door motor is not working, these need to be fixed by the landlord, he says. Likewise, if the gate remotes stop working, if the geyser malfunctions or if there are plumbing problems (but not if this is caused by the tenant putting incorrect materials down the drain) the landlord will have to call in the required repairmen. Beattie says damp and mould is a big problem in Cape Town and can often be avoided by tenants opening the windows daily and wiping condensation off the windows or walls, but sometimes this is not enough. If the unit is a south facing one or on the ground floor there is a chance that it gets very little sun and will be more susceptible to damp. The damp could also be caused by flooding from a unit above or the outside waterproofing not being done properly and the responsibility would have to be determined by an expert, says Beattie.
