This month, we continue our new line of products based on HBO's award-winning television series Game of Thrones. First up, is a fantastic mini verSIONsion of the Iron Throne replica. Based on the same sculpt as our now sold out 14" Iron Throne replica, this marvelously crACTION FIGUREted 7" verSIONsion captures nearly all the same details in a smaller, more affordable package. Next we offer a replica of the distinctive mockingbird pin worn by Lord Petyr Baelish, the character popularly known as Littlefinger. Dark Horse Deluxe has been able to craft an exact replica of the pin, true in the finest detail. Finally, we continue our line of embroidered patches based on the house sigils. As a side note, I had an awesomely happy-geek moment in Toronto when I got to sit on the actual Throne used in the series.*** Here’s a picture to prove it: Recently, a 3D printing and prototyping company called nuPROTO began selling an the Throne Dock iPhone dock, which looks almost exactly like the Game of the Thrones Iron Throne, for $49.99. Photo reproduced with permission courtesy of nuPROTO / Fernando Sosa nuPROTO clearly  realized that they couldn’t simply sell unlicensed Game of Thrones merchandise, so they included the following disclaimer on the order page:




Disclaimer: This product is not anyway associated or endorsed by HBO or any of distributors. This was an original piece of fan work that was made for personal purposes. Unfortunately, that disclaimer was not enough to satisfy HBO, which sent a “cease and desist” demand letter to nuPROTO that included the following: It has come to our attention that you have created and are currently offering for sale an “Iron Throne Dock” which replicates the Iron Throne featured on the Series. While we appreciate the enthusiasm for the Series that appears to have inspired your creation of this device, we also are concerned that your iron throne dock will infringe on HBO’s copyright in the Iron Throne, and given the distinctive nature of the Iron Throne, mislead consumers into believing that it is connected with the Series and that it originates with or is sponsored by HBO. In the end, nuPROTO relented and stopped taking orders for the dock, stating: HBO declined our offer to license the throne charging station because another company has licensed the idea of a throne charging station.




Money will be refunded to those few who bought this product and we apologize if anyone thought this was anything more than inspired fan art work.(PS. we are working on something better) What I find interesting is that HBO refers only to their copyright in the throne in the letter. HBO writes that they own “all rights including intellectual property rights” in the series “as well as elements associated with it, including the copyright in the Iron Throne design.” But the idea of customer confusion based on the design that HBO raises, while certainly applicable to copyright enforcement in some respects, is arguably even more applicable in a trademark context. I’m not saying that copyright isn’t a sound basis for the demand to stop selling the product. But later in the letter HBO even states that they are selling specific licensed products based on the throne design and people may be confused.  If they are actually selling products that are attributed to HBO purely based on the distinctive (and ornamental / non-functional) elements of the throne design, then I’d argue there’s a pretty classic trademark argument to be made as well.




So open question: Any thoughts on why HBO chose only to mention copyright in the letter? Second question: Now where do I get an awesome iPhone Iron Throne Dock? *** For those interested, a) it was awesome, b) it wasn’t metal, and seemed to have some kind of resin paint on it, and c) it actually looked surprisingly fake up close! They told me they spruce it up ‘in post’ and I nodded as if I totally understood.Though unscientific, it seems like Game of Thrones is rapidly approaching banana suit-status in the "Most Likely to See at Every Halloween Party" category. Not to say that costumes inspired by George R. R. Martin's bloody series and its HBO counterpart are tired, but you might want to stray from the store-bought variety if you want to stand out at your Halloween bash.
