That’s why Herman Miller is suing a Canadian company for selling knock-offs of its famous mid-century modern designs by Charles and Ray Eames that have a place in the Museum of Modern Art in New York City. The suit, filed in federal court in Grand Rapids this week, accuses the Toronto-based New American, Inc. of copyright and trademark infringement, and unfair competition. The lawsuit contends that some of Nuevo’s furniture products are “identical with, or substantially indistinguishable” from Herman Miller’s Eames lounge chairs and ottomans, Eames Aluminium Group and soft pad chairs, and other Eames Herman Miller products. Nuevo is likely to cause consumer confusion and is competing unfairly against Herman Miller by importing and selling furniture that incorporates one of the trademark designs or directly or indirectly uses one of the trademarked brand names, contends the company. “Nuevo sells its knock-off furniture items, directly or indirectly, to retailers, who sell the knock-off furniture to consumers, sometimes in connection with the Eames trademark,” according to the suit.
