GRAND RAPIDS, MI -- Something is wrong when you can’t tell an iconic Eames chair and ottoman from a Sonoma. That’s why Herman Miller is suing a Canadian company for selling knock-offs of its famous mid-century modern designs by Charles and Ray Eames that have a place in the Museum of Modern Art in New York City. The suit, filed in federal court in Grand Rapids this week, accuses the Toronto-based New American, Inc. of copyright and trademark infringement, and unfair competition. The lawsuit contends that some of Nuevo’s furniture products are “identical with, or substantially indistinguishable” from Herman Miller’s Eames lounge chairs and ottomans, Eames Aluminium Group and soft pad chairs, and other Eames Herman Miller products. Nuevo is likely to cause consumer confusion and is competing unfairly against Herman Miller by importing and selling furniture that incorporates one of the trademark designs or directly or indirectly uses one of the trademarked brand names, contends the company.
“Nuevo sells its knock-off furniture items, directly or indirectly, to retailers, who sell the knock-off furniture to consumers, sometimes in connection with the Eames trademark,” according to the suit. under the monikers Sonoma, Churchill, Vesper and Soprano, the suit alleges. MLive found access to those images were limited to the website's members, an image of the Sonoma lounge chair and ottoman can be seen on this retailer's website. A Sonoma chair and ottoman, described as featuring “ a bent plywood frame, cast aluminum base, and CFS foam with top grain Italian leather” were on special for $1,994, down from $2,149, according to the website of a Florida dealer. A Herman Miller Eames chair and ottoman sell for about $4,499, according to several vendor websites. An email request sent to the company’s Michigan sales representative seeking a comment went unanswered. The Zeeland office furniture manufacturer is being represented by the Kalamazoo firm of Honigman Miller Schwartz and Cohn, which is asking for a jury trial.
The law firm filed the suit Monday, Nov. 5 in United States in Western District of Michigan, contending the the court has jurisdiction because Nuevo is doing business in the U.S. and has a sales rep in West Bloomfield. Herman Miller is seeking an injunction to stop the company from making and selling the lookalikes, have it destroy remaining stock and turn over any profits made on the venture. The company is also seeking damages in the form of three times the amount of profits made on the counterfeit products plus attorney fees and court costs. Herman Miller has several registered trademarks on the designs of furniture and the brand names of furniture. Since 1956, Herman Miller has manufactured, advertised and sold the highly distinctive Eames Lounge chair and ottoman, and has a 2003 patent for the exclusive use of the design. Herman Miller also has a 1982 Eames patent, which gives Herman Miller exclusive right to use of the Eames designation in connection with furniture, according to the suit.
