Sgt. Joe Monson said Tuesday investigators came to the determination after reviewing a video recording and interviewing witnesses, but the investigation is still open. Monson says prosecutors will review the case after the investigation is complete to determine if any criminal charges are warranted. He says the child crawled underneath the chair Sept. 8, and the worker sat down later to read to the other kids without being aware the toddler was underneath. After the toddler crawled under the chair, a daycare worker sat on it and began reading a book to other children, unaware Leonardo was underneath. The boy would have turned two on Sept. 17, according to KUTV. Leonardo Sanchez died at a daycare in West Jordan, Utah on Sept. 8. "It's rough because you don't know when the last time is you are going to hold your child."The employee is not facing any charges, according to Fox 13. A police investigation into the incident is ongoing.'Somebody dropped the ball'Sanchez said the death "baffles" her. She is seeking legal representation."How could this happen? "He's a big boy. How did they lose track of him?" she told KUTV."

He brought a lot of love,” the mom said. According to police, Leo was underneath the bean bag when an unidentified worker sat down to read a book. The child suffocated, authorities said. Police said they are examining video footage from inside the facility. The employee has not been charged. “It just baffles me, makes me wonder. She must not have felt him, she must not have heard him,” the boy’s mother said. The West Jordan Child Center issued a statement, saying “We regret deeply the tragic death of a young toddler at our day care facility. No words adequately describe the depth of the sorrow we feel. “And, of course, we do not pretend to understand how devastating this is for the family.
