This Privacy and Cookies Policy (“Privacy and Cookies Policy”, “Privacy Policy”) describes the policies and procedures of Stampery, Inc., with registered office at 548 Market St #42638, San Francisco, California, 94104-5401 (“Stampery”, “we” or “us”) on the collection, use and disclosure of personal information on www.stamp.io (the “Site”) and on the services, applications, and other features or functionality available on or through the Site (collectively, the “Service”). When you use the Service, you are consenting to the collection, transfer, manipulation, storage, disclosure and other uses of your personal information as described in this Privacy and Cookies Policy. In case you are a citizen resident in European Union, please note that Stampery is domiciled and shall process your personal data in United States of America, a country which does not offer the same level of protection for Personal Data as the European Union regulations. Stampery Labs, S.L. with registered office at Modesto Lafuente, número 90, 1º centro, Madrid is the representative of Stampery for data protection issues in the European Union territory.

What Does This Privacy and Cookies Policy Cover?

This Privacy and Cookies Policy covers Stampery’s collection, use and disclosure of personal information, which may include your full name, email address, password, IP address, and other information (collectively “Personal Data”), that Stampery gathers when you are accessing the Service. This Privacy and Cookies Policy also covers Stampery’s processing of any Personal Data that Stampery’s business partners may share with Stampery.

The Service may contain links to other websites. Stampery does not control nor is responsible for the privacy policies and/or processing of Personal Data on other websites. When linking to another website you should read the privacy policy stated on that website. This Privacy and Cookies Policy only governs information collected on the Service.

Stampery is not intended for or directed to children under 18. We do not knowingly collect any Personal Data of minors and the user shall not provide any Personal Data in case it is not eighteen (18) years old. If you become aware that a minor has provided us with personal information without parental consent, please contact us at the email address listed in the Questions and Concerns section below, and we will take steps to remove such information and terminate the child's account.

What Personal Data Does Stampery Collect?

We collect the following types of information from our users:

Sign-In Information Collected

When you register for the Service, you will provide Personal Data, such as your name, password, and email address. You acknowledge that this information is personal to you, and by creating an account on Stampery, you allow others, including Stampery, to identify you.

When you interact with the Services, we also receive and store certain additional types of information that, in general, do not directly identify you.

Information from business partners

If you use any functionality provided by any business partner as required or recommended for the use of the Service (e.g. the identification and checkout functionality), such business partner may provide us your Personal Data. Such processing of Personal Data by our business partner shall be subject to its specific privacy policy.

Additional Information

If you send us an email or other message, we may keep your message, email address and contact information to respond to your request. Providing any of this additional information is purely optional.

If you use the Service while sending an email, we may have access to the subject and recipient of such email.

Information You Elect to Make Public

The Service is primarily designed to assist you in timestamping documents digitally. Most of the information that you provide to us is information that we will need in order to provide that Service. Some information, including specific cryptographic records of your timestamped documents, may be published in public places but in encrypted form. Such information will be published in a public blockchain but in hashed form.

Personal Information Collected Automatically

We receive and store certain types of information whenever you interact with the Service. Stampery automatically receives and records information on our server logs from your browser including your IP address, cookie information, and the page you requested.

Email Communications

We may receive a confirmation when you open an email from us if your computer supports this type of program. We use this confirmation to help us make emails more interesting and helpful and improve the Service.

You guarantee that the Personal Data that you provide in the above means is true and accurate and undertake to notify Stampery of any change or alteration to the same. Any loss or damage as a result of the provision of inaccurate, wrong or incomplete information will be your sole responsibility.

For what purposes we use your information?

The information we gather from users enables us to (i) operate, maintain and manage the Service, (ii) improve and personalize the Service in accordance with your needs and interests, (iii) manage your account, (iv) communicate with you, (v) provide you with information and offers about the Service, even by email or by other electronic communication means, (vi) market research disputes, (vii) resolve disputes, (viii) collect fees owed, if any, (ix) detect and protect against errors, frauds and criminal activity, (x) assist law enforcement, (xi) enforce this Policy and any terms related to our Services, and (xii) and any other purpose described in this Policy or that we describe to you at the time of collection.

Email Communications

We may use your personally identifiable information to send you emails or other communications related to your Account or the Services, or in response to your inquiries or requests. You may not opt-out of receiving service-related messages that are not promotional in nature. We may also send you marketing emails, surveys, or newsletters to notify you about products or services that may be of interest to you. If you would like to stop receiving marketing emails from us, please click on the unsubscribe link at the bottom of any marketing email you receive. If you opt-out, you will continue to receive service-related emails.

Non-identifying Information

We may use non-identifying information for any lawful purpose, including analyzing trends, research, Services administration, tracking users’ movements around the Services, and to improve our business and the Services.

Retaining Your Information

In general, we will retain your information indefinitely, or as long as legally required or allowed. If you cancel your Account or your Account is otherwise terminated, we may but are not obligated to, delete information we have collected or obtained from third parties and we may continue to use and disclose it in accordance with this Policy. 

What About Cookies?

The Site uses its own and third party cookies. Cookies are alphanumeric identifiers that are transferred to your computer’s hard drive through your browser to enable systems to recognize your browser and tell us information about you and your use of the Site such as how and when pages in our site are visited and by how many people.

Stampery cookies help to improve the User’s experience, easily navigate the Site, interact with third party sites, provide additional functionality to the Site, and analyze the usage of the Site in a more accurate way. For example, the Site could place a cookie in the User's browser that prevents the User from having to remember and enter the password more than once during his/her visit to Site.

Stampery cookies do not collect Personal Data, and we do not combine the general information collected through cookies with other Personal Data to tell what your screen name or email address is or who you are. This Site also has access to the IP address with which each user accesses the Site. The IP address with which each user accesses the Site may be different each time. Additionally, different users can share a single IP address.

Generally, our Service automatically collects usage information, such as the numbers and frequency of visitors to our Site and its components, similar to TV ratings that indicate how many people watched a particular show. Stampery may use this data in aggregate form, that is, as a statistical measure, but not in a manner that would identify you personally. This type of aggregate data enables us to figure out how often customers use parts of the Service or Services so that we can make the Service appealing to as many users as possible, and improve those Services. As part of this use of information, we may provide aggregate information, not information about you personally, to our partners about how our customers, collectively, use the Site or Services. We share this type of statistical data so that our partners also understand how often people use their services and our Service, so that they, too, may provide you with an optimal online experience.

  • Technical cookies: Are those cookies that allow the user to navigate through the Site and the usage of different options and existing services.
  • Customization cookies: Are those cookies that allow the user to access the service with some general characteristics based on a predefined set of criteria.

Because we and our third party service providers automatically collect Services usage information through the use of cookies and other tracking technologies as described in the his Privacy Policy, your selection of the “Do Not Track” option provided by your browser may not have any effect on our collection of automatically collected information. One way to attempt to “opt out” of the collection of any information through cookies and some (but not all) other tracking technology is to actively manage the settings on your browser to delete and disable cookies and other tracking/recording tools. However, getting a “Do Not Track” signal to work as you might want is difficult and may not be possible. Will Stampery Share Any of the Information It Receives?

Personal Data about our users is an integral part of our business. We neither rent nor sell your Personal Data to anyone. We may share your Personal Data only as described below.

  • In General: We may use anonymous data to provide third parties with statistics that might be relevant for the marketing and sale of their goods and services or with service providers and other persons with whom we conduct business.
  • Advertisers: We do not share your Personal Data with advertisers without your consent.
  • With trusted business partners that provide services for or on behalf of us in order to fulfill the requests and purchase orders made by the user, and in any case, in compliance with applicable regulations.
  • With any Stampery affiliate with the purpose of providing, managing and improving the Service.
  • Protection of Stampery and Others: We respect privacy of our users. However, we may release Personal Data in the event such release is necessary to comply with the law; enforce or apply our conditions of use and other agreements; protect the rights, property, or safety of Stampery, our employees, our users, or others; or as required by applicable regulations. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction.
  • With Your Consent: Except as set forth above, you will be notified when your Personal Data may be shared with third parties, and will be able to prevent the sharing of this information.

What Personal Data can I access, rectify or cancel?

You can change or access your Personal Data directly through the Service or you may contact us, by email to info@stampery.com, including in the message’s subject a clear reference to the right, under applicable law, you intend to exercise. You must also include your name and proof of identity (e.g., a government issued identification card, drivers license, passport, etc.) or, if applicable, your representative (in this latter case evidence of the authority to represent you is also required); request and right exercised; address where notifications may be served to the User, date and signature; and supporting documentation for the request being made, if any.

Stampery shall answer the requests in all cases, regardless of whether or not there is Personal Data of the User within its Personal Data filing systems. If the request does not comply with the above requirements, Stampery will request you to provide the necessary additional information.

California Shine the Light Law

California Civil Code Section 1798.83 permits California residents to request and obtain from us once a year, free of charge, a list of the third parties to whom we have disclosed personal information (as defined under that statute) of that California resident, for direct marketing purposes in the preceding calendar year and the categories of that kind of personal information that was disclosed to them. If you are a California resident and you wish to make such a request you may contact us by using the contact information in the Questions or Concerns section at the bottom of this Privacy Policy.

Deleting Your Account

If you terminate your account, your profile, including any documents you have timestamped, may be removed from the Site and deleted from Stampery’s servers. Because of the way we maintain Stampery, such deletion may not be immediate, and residual copies of your profile information or posts may remain on backup media. Even after your account is terminated, Stampery may retain and use certain data contributed by you as permitted under applicable law.

You may delete your account via your account settings page. Please note that Stampery will need to verify that you have the authority to delete the account, and some information may remain in our records after deletion of your account.

What Choices Do I Have?

As stated previously, you can always opt not to disclose information to us, even though it may be needed to take advantage of certain Stampery features.

In certain circumstances, you are able to add or update certain information as described in the “What Personal Information Can I Access” section above.

If you do not wish to receive email or other mail from us, please indicate your preference by making a modification on your account settings page. If you opt-out, you will continue to receive service-related emails.

Changes to this Privacy Policy

Stampery may amend this Privacy Policy from time to time. Use of information we collect now is subject to the Privacy Policy in effect at the time such information is used. If we make changes in the way we use Personal Information, we will notify you by posting an announcement on our Service or sending you an email. Users are bound by any changes to the Privacy Policy when he or she uses the Service after such changes have been first posted.
